Hi All, :s
My issue date is in 10 days, I've read through all of the newbie and abuse of process thread.
I've received an SAR, contacted the land owner done all of the steps up to now including AOS. I also have some pictures of the location and low level of lighting and signs.
I'm really scared I've never done anything like this before and I'm struggling to write up a valid defence.
If anyone could jump on a zoom call or something and just help me to plan my defence with the template that would be appreciated.
Its very hard to explain my situation over message hence a call would help explain the situation of the parking ticket in the first place.

1: Has the driver been identified?
No the driver was not identified.

2: Have you appealed to the land owner?
Yes, but didn't hear anything back from them. The hotel was barely running and not answering any phone calls or taking bookings.

3: Have you sent any appeals to the PPC?
No

4: On what type of land is the alleged parking offence on? (Retail park, Hospital, Train Station etc)
Its a small private car park directly next to the train station.

5: What caused the parking ticket? Was it overstaying the free time, not purchasing a ticket, parking outside of a bay?
The driver was dropping a friend of at the train station late one evening, unfamiliar with the area and train station the driver assumed that this open area directly next to the entrance of the train station tracks, looked like a car park with no lighting whatsoever which was directly next to the train tracks was the drop off or pickup point. ( Usually very small train stations don't charge for parking unless its long term or they have a drop off/ pickup point.) So the driver and the friend waited for the train to arrive and their letter states the car was parked for 21 minutes and then left. The lighting was very poor and it was very dark. Later on to find out the land was private car park of a hotel that barely even looked like it was running properly once revisited the station during daytime.

  • First of all, don't worry. I was in the exact same boat as you, everything I read on the Newbies thread I didn't understand nor did I have a clue about the legal stuff. Keep reading it and reading different threads until you begin to understand. This forum is really great at helping you defend these, and if you follow the follow the advice given to the letter, you should win! But one thing I found is you must be willing to put in the work yourself too!

    Read the Newbies thread where it tells you what you need to do and when. Somebody will be along soon to advise you further on this. A few questions need answering however;

    1: Has the driver been identified?

    2: Have you appealed to the land owner?

    3: Have you sent any appeals to the PPC?

    4: On what type of land is the alleged parking offence on? (Retail park, Hospital, Train Station etc)

    5: What caused the parking ticket? Was it overstaying the free time, not purchasing a ticket, parking outside of a bay?

    Please answer these questions and people will be along soon to give you further advice. In the mean time, keep reading the Newbies thread and other threads on here. I also have a thread on here where I was in a similar position to you, go ahead and read it and see the advice I have received!

    as for the SAR request is there anything else I need to include or is there a template I can use?
  • The SAR is also included within post #2 of the Newbies thread. Have a read of that and it will tell you what to include and there is a link to a website which has a template for you to use.

    Yes I found it and have completed that also, is there anything else I'm forgetting to do?
  • Post #2 suggests that you should treat this as a last gasp chance to appeal by emailing the litigation team at ParkingEye.

    You say the driver stopped at the shopping village for just over an hour and left. They offer 2 hours free parking for customers. I'm not familiar with the shopping village, is it a retail park with a number of shops/restaurants? Were any of these open at the time you arrived? What did you do when you went on the break, go into a cafe? Just walk around? Or did you just sit in the car?

    Was it an ANPR camera that caught your vehicle? I assume due to the time it wasn't a parking warden who issued you a ticket?

    The reason for my questions is it seems like you have a strong case and may be worthwhile emailing the litigation team to try and get this cancelled.

    Somebody will be able to offer more advice soon but it would be a good start if you could answer those questions above.

    Quick update as to what I've done so far after receiving the letter this morning:

    - Complained to the land owner
    - Requested SAR from parking eye through their privacy form
    - Emailed the parking eye litigation team on why they should stop the claim

    You will have to try to explain your situation in words and/or pictures.  No one is going to offer you a video call.  NOW if you receive any offers you should be very wary, particularly if the guarantee to sort it if you PAY.

    Why on earth have you over-written your opening post?


    You are now saying that you have a hearing in ten days. That means you have already filed a Defence, yet you say " I'm struggling to write up a valid defence".

    You have either written and filed a Defence or you do not have a hearing in ten days. Which is it?
