Read from page one of that thread, the whole lot, in case you then get offered a telephone hearing instead. The difference is, the new forum advice is you have little choice with those hearings and to engage with that (it's not ideal, but the strategy there is to email your stuff to th PPC's solicitors and lead them, not be led by them).
To object to the case being heard 'on the papers', you need to grab the wording from the middle bit of my email about why harings on the papers are not fair on Defendants v parking firms who ambush them at the death with a pile of papers you can't then rebut at a hearing.
Almost every time we hear about, people lose when PPC scam claims are heard 'on the papers'. Do not let this happen.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The question posed was how can a Judge make a decision on a paper hearing...if he doesn't have the witness statements
Surely that is a question you should be asking a judge.You never know how far you can go until you go too far.2
