Hi, Firstly apologies if I posted in the wrong category, I couldn’t find the right topic for my post so I chose one best suited. Anyway, it’s a bit complicated but I’ll try to keep it as short as possible.
EDIT: Please read before answering, as some people obviously haven’t, this wasn’t entirely my fault. I’m also trying to sort this for a friend on their behalf.
So I booked a SIA door supervisor license (security) online. The course is 4 days, I went in for 2 of the days but missed the last 2 days because I was unwell. I contacted the training provider ( Get Licenced) and they said based on the situation “just this once” and as a “goodwill gesture” they’ll allow me to reschedule without paying a reschedule fee (which I believe is £90).
So I was given the next available course date for the 2 days.
The issue is that I now can’t get a refund or another reschedule date, which is extremely unfair as It was £220 for the course and I couldn’t attend all of it as i was unwell. ( I get severe episodes of migraines preventing my ability - which is why I couldn’t go in).
I did read the terms and conditions on their cancellation and refund policy and I think it’s ridiculous.
Realistically speaking, I’ll probably never be able to get my money back as it’s states in their t&c’s but it’s more of the Principle - the fact I can’t be refunded for something I purchased. Even make a complaint or whatever I wouldn’t win. Because of all this the law need to be updated, you can get a refund on a faulty Tv for example but not a training course? Companies are exploiting and taking advantage of your money because there’s nothing stopping them/
I posted on here specifically as I didn’t know what else to do and I’ve seen a lot of posts with really helpful responses so I thought it’s worth a shot
.
Any help will be much appreciated.

There are two sides to this and you need to consider the training provider. They gave you their agreed services the first time and aren't responsible for the fact you were too ill to attend the whole course. They also allowed you a second time as good will at their own cost. They could argue they have lost money by keeping a place open on the second course for you that they couldn't fill with a paying customer.
If I was the owner of the training company I'd argue you were exploiting them if you ask for a refund - they have suffered a material loss through no fault of their own and have been generous enough to waive the reschedule fee.
Put this down to experience and move on.0 -
You broke the contract, they didn't. They did more for you than they needed too.
You're comparing your breach to a faulty TV, you're having a laugh.
You have no rights to a refund, it's £220 not exactly a big loss and you went to trading standards and BBC watchdog? Don't hold your breath for a reply.0 -

Even if I do go to the small claims court or whatever I wouldn’t win. Because of all this the law need to be updated, you can get a refund on a faulty Tv for example but not a training course? I’ve complained to Trading standards and contacted BBC watchdog regarding this.

You would have been entitled to a refund had the trainer failed to turn up to teach you, because you do have rights. In this case though the trainer was there at the agreed place and time, but you weren't - and then you failed to attend a second time. The law doesn't need to be updated to offer a refund in this scenario - the only thing that requires updating is your attitude.0 -
Have to agree with the others - you were rescheduled and you missed the second date. That's not the trainer's fault, that's yours. All shall be well, and all shall be well, and all manner of things shall be well.
Pedant alert - it's could have, not could of.0 -
Your condition makes no difference to your rights. So your point is moot.
The quicker you accept this the quicker you can move on and put it down to just bad luck.0 -
Surely a health related problem that affects only you then how can it be someone else’s fault.
I think they were generous to reschedule after your first failed attendance. For you to then fail to attend the rescheduled date is entirely your fault and you are not due any refund or goodwill gesture0 -
Ridiculous complaint. YOU broke the contract. The service provider was more than generous and understanding. You rebooked and 'forgot about it'. Really, who is to blame here? You, who couldn't put a date in a diary or the service provider who gave you a 2nd chance and you blew it!0

RainingRoses wrote: »Hi, Thank you for your reply and thanks for taking the time to read through my post.
I do understand and appreciate what you’re saying, but my point is that I couldn’t attend for a reason that’s not entirely my fault, as I said I have frequent migraines and Hemiplegic ones affecting my ability. I mean why should I have to pay again?Maybe I didn’t explain myself to well as I’m trying to say this is unfair you SHOULD be able to receive at least a partial refund in certain circumstances.
I’m just glad I didn’t book the personal protection course, which I wanted to do, as I would’ve lost £2000.
I hope you can see my point of view, but regardless thanks for your response.
And the course provider was generous enough to offer you a further course date - which you accepted. It was entirely your fault that you failed to attend the second date because you forgot - far from an exceptional circumstance by any reasonable interpretation of the phrase.
Sorry, but no, I can't see your point of view and I very much doubt you will find that anyone else will either.0 -
Is this a serious post? I am struggling to believe somebody would act so entitled.0
-
So you didn't make it to the last two days of your first course and then forgot your second and you think you are due a refund and its unfair that they aren't giving you one?
Just wow!!0
