Nope thats normal. Took me a month with Monarch and that had nowhere near as many claims. Given it was flight only you have no other recourse open to you.0

I believe the CAA has been negotiating with the major credit card issuers to reach an agreement on who will deal with the claims so that people do not get pushed from pillar to post. The system goes live next Monday, and yes they have admitted it may take 60 days to clear all claims. When you consider there are 840,000 package passengers to deal with that does not seem unreasonable
The CAA will not be involved in flight only bookings since they were not covered by their ATOL, so that has to be a direct claim against the card company. As others have said, 1 to 2 months appears to be the average, some are clearly much keener than others to get the job done.0 -
N4t4lie, Thank you. I am unable to quote your last post to me as I am a new member and am being told I cannot quote posts . No idea why as I quoted you previously.
I contacted the bank and the first thing they said was, once again, that I could not use the chargeback scheme. So I told them I wanted to make a formal complaint. They took all the details and asked why I felt a chargeback should apply. I told them I purchased goods from Gotogate that had never been received.
Will let you know how it goes. Thanks again.0 -
I paid for my TC flights later this month on my Debenhams CC in July. I did not use PayPal and I booked direct with TC Airlines online.
I have lodged a Section 75 Claim with Debenhams CC (which is administered by NewDay Ltd). They have written to say that on this occasion they believe that the most appropriate route is not to deal with the dispute under Section 75 and they will be seeking to chargeback the transaction to TC on my behalf. They said they would send me a disclaimer within the next 7 days.
I have replied saying I wish to continue the Section 75 Claim. I pointed out to them that I would have more legal protection as Section 75 is enshrined in law and CC providers have to follow it.
Grateful if someone could confirm I have done the right thing.
Many thanks0 -

Let the card provider deal with it as a chargeback.
It will be much quicker for you, and the refund will be quicker.
If that fails it will then move to S75. But I do not see the chargeback failing.
Many people seem to be hung up on S75, when there are other options open to the card provider that are better.Life in the slow lane0 -

In simple terms it costs the card provider less to get your refund using a chargeback and the money is guaranteed to be refunded by the administrator.
S75 will get you back any other costs you may have incurred, but as it is a straightforward refund there should be no difference in the outcome. There will be a disclaimer on a chargeback claim to say that the money can be taken back in 100 days, but this is in case the person you did the chargeback against can prove you did it fraudulently. In this case it's pretty obvious you're not.
Either way you will get a full refund and there's half a chance the person you spoke to thinks they are the same process, so you never know it might be being done under S75 anyway. Confusion with S75 and chargeback in banks is very common!
I bet they rue the day people like Marin let us all know about these things and clued up the consumer to their rights.0 -
Thank you born again and N4t4lie.
I had possibly misunderstood the guidance that's out there. I was under the impression that chargeback was more applicable to payments made on a Debit Card and that S75 applied to Credit Card payments.
I should know by now that things are never as straightforward as you'd like to think!0 -
Wonder if anybody can advise of our situation. we booked an NCL cruise through TC and had been paying by DD. Our bank has told us that we cannot claim back DD as they were paid to the intended recipient. NCL have sent out a new invoice for cruise but only showing deposit paid and haven't received any of the monies paid by DD. We are not covered by ATOL as booking was cruise only. We have already paid £3400 by DD. We are not sure how to proceed.0

Your bank is correct if the DD was paid to the correct recipient (NCL). If the DD was to TC you should have a claim.
I would read the section about non-ATOL protected bookings on MSE’s very informative report - https://www.moneysavingexpert.com/news/2019/09/thomas-cook-seeking-p200m-extra-funding-/?_ga=2.108029061.604875785.1540842026-1344478144.1443270551#abta
You might wish to investigate if NCL is an ABTA member.
I think this is a discussion you needed to have with NCL. The key is to where to DD payments went. Your bank statements should indicate this.0 -
Hi thanks for the reply. The payments were all made to TC0
