We have approached Capital on Tap for a refund via section 75. They are now saying that it is a pre-paid top up card and therefore it is a debit card so no cover. We have never pre-paid anything and the bills are just like a credit card bill?
Are they credit or Debit?
Can't help with your credit card issue (it does sound a bit weird), but if they are saying it is a debit card (I assume it is Visa, Mastercard or AMEX) and not a credit card you can still reclaim your money back using Chargeback so saying you can't get a refund is wrong. See the main MSE site for more information on Chargeback. I'd get back on the phone to them and try to talk to someone who knows, if the person on the phone seems like they are trying to fob you off raise a complaint so they have to look at it properly. Hope that helps.0 -
So we have a package booked via On the Beach. Flights were with Thomas Cook, hotel not. It was all booked at the same time so fully protected. My understanding is the onus is on the agent to make all reasonable efforts to source alternative flights. I've checked and there are flights available from same airportt on same dates with both Jet2 and Ryanair, but On the Beach are saying they are unable to find us alternative flights.
Are we within our rights to challenge On the Beach? It feels like they have made no effort at all.and just want to refund us rather than pay out the extra for replacement flights. What constitutes reasonable effort?0 -

Challenge them. Of course they have an obligation to look for alternative flights, so by all means suggest what you have found. However if the cost of the replacement lflights is too high, they can decline on affordability, if you don’t want to pay towards the difference.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. A number of online agents appear to have decided to cancel everyone's holidays for the next month and simply offered a refund. Others have decided to pay up an additional £100 or whatever but some airlines and Jet2.com have been specifically mentioned, appear to be changing the price on the final page before paying by hundreds of pounds and I think the CAA would probably be sympathetic to the view that a refund is a fair outcome in those circumstances.0

There is now a rumour going round Twitter that those who paid via DD wont be getting an automatic refund if they cancelled the Direct Debit, which is what the advice was to do last week.
Cant see this being true, surely refunds will be bank transfer which dont need an active DD. Also there is no mention on the CAA website of this.0 -
Hi has anyone used and claimed from the company “Protect my holiday “ a company whom for a small charge will cover for flights and hotels going insolvent0

It's about time TUI closed down their bookings website.
There is nothing on it to say that the company is no longer operating.
As an experiment, today I picked a holiday at random, and went right through the booking process as far as the page where I would have entered my name and address. I didn't risk going any further - but at no point was there any message to say that I couldn't book, or that the company was out of business.
I wonder what would have happened if, for some reason, I had not been aware that they'd gone bust, and had carried on with booking.
EDIT:
Sorry - senior moment - wrong company!0 -
Erm.....the above poster knows that TUI are still trading and its Thomas Cook who have gone bust, yes? :beer:0
