Hi guys, I have recently read direct debits hopefully will be refunded in around 14 days. Thanks great news, however not sure what happens in my case.
So when I first booked my direct debits were over £300 a month. Then I was able to ring them up online and repaid £1000 via my NatWest debit card. From then on my direct debits came out monthly at approx £193.
Have you any ideas how this works as paid cash over phone by debit card plus from then on as I said direct debits. I cancelled the last two payments for Oct and Nov as my bank stated to do so.
Will it all come back together? Or will direct debits be refunded and will have to claim the thousand separately?

Also a hotel booking only, prior to flying next day at £56 non refundable, will ATOL pay this too?

You will need to put in an ATOL claim for any debit card payments, the rest will come back to you automatically
That hotel booking? Insurance but the excess probably wont make it worth it.0 -

My question is who pursues the claim? Me or the agent?

Thanks for pointing out none of this is straight forward, many people are in more complicated situations than the advice covers.
In this case I would say wait to see what is refunded via the DD refund and take it from there. I assume you had a package that is ATOL Protected so you are entitled to the full amount back on way or another. If I were you I would go back through your bank statements and add up what was paid by DD. If the amount you have paid by DD plus the debit card payment is returned then all is good, if not you will know you are the card payment down and put in a separate claim. Sadly until the DD refund is made I doubt anyone knows what happens if you made mixed payments. Let's hope that a human is involved in processing the cases and they can make a sensible decision in your case and refund you the full amount.
As for the hotel ATOL won't cover that unless it was part of the overall package. You can't use a chargeback as the hotel is still trading and can provide the service you have paid for. Your best approach might be to contact the hotel explain the situation and see if they will give you a credit note against a future booking with them, but that would be down to their goodwill and not anything legal.
The other route would be your travel insurance, but you might find that the hotel cost is less than your excess, but worth checking.0 -

Media seem to be making a big point today that its going to take 60 days for people to get refunded. That's hardly news, the CAA announced this not long after the collapse0

We had two flights to Mexico booked for January with TC. We paid them by Capital On Tap Credit Card.
We have approached Capital on Tap for a refund via section 75. They are now saying that it is a pre-paid top up card and therefore it is a debit card so no cover. We have never pre-paid anything and the bills are just like a credit card bill?

RE: the ATOL scheme. I've paid off my holiday in full but when I did pay I paid via my debit card, paying different amounts each month. Does this technically mean the following applies to me?
"If you paid by direct debit, ATOL refunds will go ahead now. The CAA says it'll refund direct debit bookings covered by ATOL within 14 days – these will be processed automatically, so you don't need to do anything."
How do I know if my claim is being processed or do I just wait and hope that it will show up in 14 days time? Rebooking my holiday tonight so if it will indeed be in my account in the next couple of weeks that would be incredible!0 -

No, because debit card payments are not a direct debit. Claim via the ATOL form/portal that goes online next Monday.0
