Iv booked replacement flights already (altho nearly £1800 more) going on the basis well defo get the original flight price back and then appeal to get the additional cost back under section 75 as it was on credit card and they are obliged to cover consequential loss.
Can you link to that?
I know some travel insurance policies cover consequential loss, I haven't seen anything suggesting that credit card companies will do any more than refund what you have paid out.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. We booked BA flights though Thomas Cook and paid in full, we have received E-tickets from BA and can see reservations on there site and we are flying on Saturday 5th October 2019 is our booking likely to be cancelled due to Thomas Cooks collapse?

We have a now cancelled booking with TC. I have cancelled the DD and am now looking into the refund process.
My friend paid the deposit on her CC and the DD came out of my bank account.
What is the quickest and simplest way to claim our money back. Would it be through the CC or ATOL.
We have already made alternative arrangements but it's going to cost me an extra £140 a month until the refund comes back and I could do without that so wondering about time scales.
That said my thoughts are with TC staff after all its only a holiday for me0 -

I’m getting a little bit confused now as i’m told two different bits of info.
Package holiday booked to New York through TC but flights through Virgin. Was in the city so popped in to store for Virgin to seem surprised that I was even querying it and that flights are more than likely to be fine but can’t check at the moment as too early.
However, I had messaged them on Facebook and I saw them telling a few people to do and their response was that our flight tickets hadn’t even been issued and therefore not valid.
Seemed annoyed that the sales advisor had told me differently and that I needed to contact the CAA immediately (i’m Guessing contact details are available as of the 30th)
At this point I figure this holiday is dunzo and it will be easier/cheaper to rebook elsewhere but I don’t want to get stuck paying for two lots of flights which is exactly what the sales advisor said.
Any suggestions??0 -

When you paid for the holiday were you issued with a Virgin flight number for check in or a PNR number? If you did it is likely the flight was paid for and you therefore can still use it. If not then there is a possibility that the flight was never confirmed and paid for so you will not be able to use it.
I would assume the hotel and any transfers and extras booked will not have been paid for.
I am not sure how ATOL works for claims and whether you have to cancel the holiday and get a full refund or can just apply for a partial refund. My experience of rebooking holidays came when LowCost went under a few years ago and they weren't ATOL.

I think ATOL has to be tried before S75 credit card route, also if TC were acting as the agent and not the direct supplier of the holiday S75 might not apply so it would be processed as a chargeback for the deposit only. Also bear in mind it may also depend on who is listed as the lead passenger on the booking as I believe they will have to submit the form to ATOL.
My personal suggestion is to get the ATOL claim in as soon as you can. Sorry to not be able to give a straightforward answer but hope that helps a little.0 -

Hi, I'd agree with silvercar that you are most likely OK. I will add to their comment that TC will have just acted as a ticketing agent in this case and if you can still see your reservation, reserve seats, change meals etc on BA's web page that you own the flight and it cannot be taken away from you. What happens if someone has booked and paid for a flight only via Thomas Cook but the airline isn't Thomas Cook? Emirates in this case?
Did you receive an Emirates booking number or PNR number when you booked? If so go to Emirates web site and check to see if you can access your flight details. If you can, then it is paid for and cannot be cancelled. TC will have just acted as the booking agent in the same way other online companies do.
