Copy of the claim and copy of the PCN or something you hold that shows it's you?

  • Because they dont mention entry/exit times on the claim form, only a contravention occured at 15:15, should I add this into the defence? Stating that some facts are missing?

Yes but not yet, as you do not send anything with the defence. As the NEWBIES thread tells you, that comes at a later stage, pre-hearing.

    • Defence sent on time

    • SAR recieved, pics are very dark but it is obviously my van, cant really see who is inside.

    • No DQ so will call courts tomorrow if nothing in the post.

    • I will be stopping at the same carpark tomorrow so will take video and pics, last time I was there I noticed a sign had been moved from the dodgy bend on the way in to a more prominent point at the entrance... any ideas on pointing this out?

Use Google Street View and change the date using the little arrow under the snapshot image, you should be able to track when changes were made, if that street has been captured ore than once over the years.

Then in your WS you can use GSV images plus your new images, to show how bad the signs were at the material time and that they were altered/moved since.

That is as close as I can get to it. I thought the sign was on the post right in front there but maybe it was behind the bush, the current one cant be seen from there at all
  • Also, I spoke to the manager of the shop on a telephone call last week. She said she would email TPS to request they withdraw their claim. I have emailed TPS about this twice since then but they have failed to respond. Helpful, unhelpful? I could try calling both again tomorrow if its not going to make it worse...

I can't see any obvious entrance signs at all, so that evidence will be good, added to your current new photos.

That retail park looks - to anyone's eye - unrestricted. There are no terms or 'P' sign visible as you drive in, and there appear to be a lack of signs anywhere near any cars.

Just two blue signs on the wall of the actual buildings but they could not be seen if you walked from a car straight in through the doors of a shop, as you would.
