A store is no different to your home. If you invite someone into your home and you have a sign saying "CCTV in operation" & "the taking of pictures is forbiddin in this house" the person has a choice. If they don't wish to be filmed, they don't enter. If they enter and take pictures you can ask them to leave. If they refuse to leave you can call the police to eject them.
While many people object to the intrusion of CCTV, other welcome it. In this case it will clearly show if the OP was assaulted, the police should have siezed the disc as soon as practical after the assault was reported. Ms Chocaholic just looked at the posts in question and I have answered those Qs. Like many you are missing the point anyway. Tesco staff have no right to manhandle someone for taking a photograph. Your misunderstanding of basic legal principles is almost criminal in itself.
Webtalk I know they wouldnt have been discounted if perfect but I honestly didnt see the harm in removing a banana that was clearly unfit for sale. Right or wrong that doesnt merit the sheer verocity that Tesco, and some of the posters on here, are showing me.0 -
Here are the three questions (at least) which you haven't given an answer to:
Why you chose to remove the banana you took dislike to, you hadnt paid for them so it wasnt your choice to remove the banana you didnt like
Why you didn't raise the point with a sales assistant in the fruit section about why there was a rotten banana
If you didn't like what was in the pack, why in heaven's name select it in the first place
Another question would be, why if you removed the banana from the pack before you got to the till, why did you not take a photo of it there and why did you feel the need to take the banana to the till with you.Thrifty Till 50 Then Spend Till the End

So you know the law regarding food unfit for human consumption. You know the law of what constitutes an assault. You know the law of what constitutes false imprisonment but you don't know the law with regard to interfering with goods which don't belong to you?

I'd DEFINITELY only have removed it after telling the teller I wanted to do so. I'd also have asked her if she wouldn't mind throwing it away for me (I can't stand the smell of ripe bananas).
I'd also DEFINITELY would've cut my losses on the unhappy banana in the knowledge that I'd got the rest for a discounted price.

As is often in these cases we only get to hear one side of a story whch will have the predictable slant on it. Yet again though we see a situation arise over trivia that, given the limited information available, was badly handled by both sides ... why in 21st century living in this country are we so incapable of handling trivia .. there is far too much 'I know my rights' and 'matters of principle' about instead of the application of common sense.
What is most disturbing is that valuable police time looks like it is being wasted on this trivia .. although I am sure the police have been making jokes about a banana scandal since it was reported.

Also maybe the OP mentioned the person ethnic origin because new settlers to this country sometimes don't have an idea to our customs and behavior.
I think if people want or need to come to this country they need to learn our customs and how we live & if they don't like it then leave , anyway I'm going off track here but just wanted to get it off my chest:D

Then 2 more staff members accosted you, so that's 3 counts of being manhandled.

let it go cause if you take this further you'll be laughed out of court and maybe even get done for wasting police time.0
