    If they do so (which is almost inevitable), deal with them as per the NEWBIES FAQ sticky, post #2.

    Okay so I'm now getting prepared and doing my research to compile my defense but can't find any examples of over stay? I basically bought a ticket and returned 23 minutes late as I had to speak to the manager about an issue and was responsible for a large group of children as it was my daughters ice skating party. My partner and friend also drove children to the party and parked and also got issued fines for £60 each for a 23 minute over stay. As well as trying to win this could I look to get their money back as they paid it also.
    Please could anyone point me in the direction of defence for an over stay?

    That's all Witness Statement stuff.

    Post #2 of the NEWBIES thread tells you that a Defence consists of legal arguments.
    Things like -
    - the signs were poor such that they were incapable of being the basis of a contract.
    - does the PPC have authority to sue people at this site.
    - the abuse of process paragraphs about excessive charges.
    - etc.

    Read the Defence examples in post #2 of the NEWBIES thread - especially those concise Defences by Bargepole.


    And what did the manager say when you complained to him?
    Pointing out that you are unlikely to use their facilities again as you now know it comes with a hefty surcharge.

    It wasn't an overstay it is an issue of insufficient grace periods. But, as KeithP says above, read all of the 17 pre-written defences. PLUS you could search the forum using overstay defence successful as your keyword(s).

    in people's experience how long does it take for court papers to be issued?? I received the letter of claim on 12 July

    The PPC has 6 years to try a court claim

    It can be several months before they issue an mcol Court claim following an LoC

    No news is good news

    Okay so I've received in the normal post a claim form with the court address Northampton. Does this mean they intend to take me to court? I'm 36 weeks pregnant and thought they'd have given up by now.
    Presumably I need to reply and act quickly?

    What is the date of issue of the claim?
