  • guohong I'm in almost the same situation as you. I visited Bibury Trout Farm in August as I had done in July and June (My son loves fish especially trout ). Next thing I get a fine for parking non-payment. They must have brought this system in during July.

I paid for entry by card and have proof of that, doing so entitles me to free parking. However, i didn't enter my reg details in their terminal so I received a fine. There were a number of mitigating circumstances, which I won't bore you with here, one of them that there was no payment terminal on display at all.

I called BTF and got nowhere. They said the same to me that they had no power to intervene. ARDPark refused my appeal and now i too have a Debt Logic "letter before claim." Reading the posts above and other info on here I think I have a decent chance of winning if they take me to court.

I’m tempted to treat this as an official LBC and follow the steps advised in the newbie post. Just to be on the safe side.

    Anyway, the letter says:
    Dear Mr xxx,
As all our previous attempts have failed and you have not made a payment or successfully appealed, the balance due remains outstanding and we req full payment within 14 days from the date of this letter. If you fail to make payment or provide a reason for non-payment within the specified timeframe, we will recommend our client with County Court action (Sheriff Court in Scotland).
If you wish to prevent the potential escalation of your account you should pay your balance immediately or make an offer of repayment by contacting us asap. Alternatively, please make payment using one of the following methods: (several methods here)
    Court Proceedings
Please do not ignore this letter, if legal action is taken against you it will affect your credit rating and ability to obtain credit from lenders for 6 years, unless you satisfy the CCJ in full within one month of issue. Please see FAQs on our website WWW.debtlogic.co.uk for more information about County Court Judgements (Scottish Decree).
We would like to bring to your attention the case of (some blank, seems they forgot to fill) in which the court upheld that parking charges serve a legitimate commercial interest and are neither extravagant more unacceptable.
We don’t want to refer your account to our Litigation Specialist so if you’re having financial difficulties, the sooner we hear from you the sooner we can help. If you do not contact us by 30/10/2019 we will have no alternative but to continue with further action.

Hi, please can you let me know the outcome of your situation? I'm in a similar situation with Ardpark but i cannot see, in this forum, how this was ever resolved.

It could take 6 years for this to be resolved (statutory time limit for a case to be taken to court).  I suspect there has been no conclusion to the above case, but you might try sending a personal message (PM) to the OP to ask them.

If you want forum help with your case, please open a new thread - but please read the NEWBIES FAQ sticky first which provides comprehensive guidance on how to deal with private parking charges.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Just when I thought they'd given up, I received another letter from BWlegal (previously Debt Logic) so I think I'd better give an update. Obviously I am not the only one because I also got a message on TripAdvisor from another victim. It seems that they sold the debt to another debt collection company. Nothing new on the letter, only the deadline for me to make the payment was extended to next week.
I am planning to ignore the letter, as usual. Any advices/suggestions are welcome and appreciated. And I can also inform the other several victims who contacted me through other channels.

Is this latest letter a formal Letter of Claim or just another debt collectors letter?

If you are not sure then perhaps have another look at the second and fourth posts on the NEWBIES thread.

By the way, no-one has 'sold the debt'. It remains with ARDPark.

    Thanks KeithP.
Have read the 2nd and 4th posts on Newbies but sorry still not too sure although I believe it's a debt colletors letter. There isn't anything like Letter of Claim of Letter before Claim on the letter. Also it says "...non payment by 09 March 2021, further collections activity will continue". It also says in "Next stages if we do not hear from you", "..., this may proceed to our legal process and the next contact from us could be a Pre-action protocal letter from claim..."
So I suppose this IS another debt collectors letter and I should simply ignore it?
    thanks.

Yes, that's debt collector's letter. File it away with all the other correspondence.

    Another recent update.
After another DCA, I finally received a Letter of Claim today. Strange that I even feel a bit excited...
After reading the Newbies thread again, here is waht I am going to do at this stage. Could anyone advise if I missed anything?
1, write a SAR email to ArdPark, requesting information listed in the thread.
2, write another email to BW legal as per listed in the thread.
Is there anything missing? What should I expect in the next stage?
    thank you.
