ARDPark PCN

Another quick update: Kate replies and says that ARDPark now says the PCN was due to the overstaying. Our ticket was valid until 16:10 and we left at 16:09. They said we parked for 2 hours and 10 minutes, yet we only paid for 2 hours. but they allowed 10 minutes for buying tickets after arrival, and we could not pay the ticket retrospectively! I feel it's getting more and more ridiculous!
Have sent Kate another email and will update after I received a reply from her.
Any advice on if they issue court proceedings how much chance a judge will support their claim?
many thanks.0 -
Don't bother with IAS as already advised.
Write back to unhelpful Kate and quote the comments in red from post 1 of the NEWBES made by our MPs in open parliament. She and the company she has contracted is one of the reasons a new parking bill had been introduced in order to curb the excesses of these unscrupulous companies.
Point out that driving around waiting for a space is not parking, as defined in the case Parking Eye vs Ms X at Fistral Beach.
http://parking-prankster.blogspot.com/2014/03/waiting-for-space-is-not-parking.html
ANPR only records entry and exit times. It does not record parking time or time taken to find a parking space, and has many other flaws as well. The UK Government has banned the use of ANPR systems for monitoring in council and local authority car parks as they deem it unfit for purpose.
State that if the scammers take you to court, you will be calling on her to appear as a witness.
Complain to your MP about this unregulated scam.
Please do complain NOW on Trapadvisor etcetera to warn people about this scam and the horrendous cost of parking if a motorist is delayed by a few seconds from being able to park.I married my cousin. Did exacted as what's been suggested. She came back without any positive response. She simply forwarded me the reply from ARDPark, which asks me to go for IAS appeal.
Maybe the farm truly can't help with this matter?
I probably will have to consider the next move.
If I skip IAS appeal (by the way, I didn't reveal who the driver is. They chase me as the registered keeper, who shouldn't be liable for the charge?), any suggestions for the wording sent to ARDPark please? And any advice on what may happen afterwards? I don't mind end up spending a bit more money, better than simply giving these bloodsuckers an easy £100, however I do not want to end up in empty bank accounts...0 -
From the Ardpark website:
We are a family company setup up in 2018 to revolutionise the parking industry. After working in the industry for many years we felt that ANPR had become an inflexible tool that Car Parking Enforcement Operators, known simply as Operators, used to penalise drivers who broke the rules rather than as a tool for landowners to control parking for the benefit of their community.
https://ardpark.co.uk/about-us/
So as you have found out they are actually no better than any of the other PPC's the above is a lie.
If they really are; " tool for landowners to control parking for the benefit of their community".
Then the landowner should be cancelling this forthwith!
They are a new boy on the block and it remains to be seen if they have the neck to try court with such a minor item as this but even that wouldn't "empty your bank account", I assume they would go through the normal useless debt collection route though which can be ignored.1 -

Write to her again and tell her you expect this to go to court. Ask her which member of her staff will be appearing as a witness to be questioned under oath.
Sometimes the thought of having to go to court focuses their minds a little.
Personally I would say your chance in court would be good if it comes to it. I suspect they will threaten lots but do little.1 -
What about the keeper non liability thing? I successfully appealled to POPLA using that in another case.0

I see. missed that Q&A.
I know that I won't get better advice so did exactly what I was told.0 -
The farm replies and refused to be attending any court hearing. Do they have to if I call on them to appear a witness?
I start to have sympathy to the lady because it's the ARDPark scamming me not them... and I feel talking to her will end up with nothing.
should I simply write to ARDPark and invite them to issue court proceedings?0 -

Tell her that as she will not cancel the ticket then she has no choice but for someone to attend. Remind her this is court not an optional day trip. Tell her she is not understanding the seriousness of refusing to attend court and she should seek professional legal advice.
Sounds like she's a bit panicked at the thought so ramp the pressure up.1
