^This. Once the bumper has been cleaned off I'd doubt it would require more than a smart repair.

Plastic surround for the fog light is not in picture, probably broken. Square plastic on ground is a mystery? Middle light is probably damaged mis aligned. Fog light could be damaged. Sounds like a cheap quote to me.

I can see why you would want evidence but 3rd party may feel easier to go though insurance.

If both parties do not intend to declare the incident any evidence kind of incriminating. Also if anything comes up further down the line the question will be asked why insurance not informed.

There is a chance the 3rd party will not bother getting it repaired if you pay them directly in cash. May be an end to it though.

Basically your options are to agree a settlement that you are both happy with, or to go through insurance. If you don't want to go through insurance then you are not in a strong position to start demanding to see paperwork from the garage, or that you pay the garage directly - ultimately he's the one doing you a favour by not involving your insurer.

    So maybe just ask yourself
    (1) is £395 to make it go away worth it to you? And
    (2) do you trust him not to come back and ask for more?

If the answer to both questions is yes then pay him cash and further about it. If not, give him your insurers details and tell him to contact them (and obviously contact them yourself).

It makes no difference to the OP whether the other guy spends the money on repairs or not. And from a legal standpoint it is also irrelevant. The other driver is entitled to compensation for the loss of value his car has suffered - and that loss of value is usually measured in terms of the amount it would cost to repair. However he is not under any obligation actually to get it repaired; if he would rather put up with the scratches and spend the money on something else he is perfectly entitled to do that instead.

It doesn’t matter what the 3rd party spends the £395 on if it is the end of the matter. Just OP mentions evidence. Could be, has it been repaired or actually costs what has been quoted? Some might say if it goes no further it is worth it. Others don’t want to feel they have been ripped off. Or could be they don’t want it to come back to bite them. We do not know why OP wants evidence.

OP is not in a strong position to push for evidence. If they trust 3rd party fine. If they want reassurance it has been dealt with and will not come back to bite them later going through insurance seems the way to go.

no you are not she is claiming off her insurance which is her right. Also she may have thought that you were behaving awkwardly so decided to just let the professionals take care of it.
