    On their PDT machine report which I requested they only sent me my record. I'm not sure if I read somewhere I should request all payments on that day. Can someone please clarify?

    OK today I have received the claim form. I will do the AoS later today then pull up my defence which I did a few weeks ago and go through it. I will then put my defence up in here for the experts to look through it.


    Everyone's help is much appreciated.

    Hold off doing the AOS until 5 days after the Date of Issue shown on the claim form, or you're in danger of missing out on your full 33 days.

    If you can give us the Date of Issue, KeithP will provide you with some deadline dates and a list of actions you'll need to be aware of in the preparation of your case.

  • The date of issue was the 11/11/19. Therefore I have until tomorrow 15/11/19 to AoS. I did it this afternoon before reading your comment.

    You had fourteen days from the date of service, and the date of service is five days after the date of issue, to complete the AoS. In other words, you had until Monday 2nd of December to file an Acknowledgment of Service.

    Still, what's done is done. Let's move on...


    With a Claim Issue Date of 11th November, and having done the Acknowledgment of Service, you have until 4pm on [STRIKE]Monday 16th December 2019[/STRIKE] Thursday 12th December 2019 to file your Defence.

    [STRIKE]Due to early filing of the AoS, you might want to ensure your Defence is filed a couple of days before that.[/STRIKE]

    That's [STRIKE]over[/STRIKE] four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.


    When you are happy with the content, your Defence could be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. No need to do anything on MCOL, but do check it after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure. Just file it.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

    I think it's now going to be 28 days from today's date-Thursday 12th December.

    Yes, I agree. I didn't allow for the weekend days.

    Doing the AOS too quickly, as you did, shortens your time to do the defence now. Not great but hey ho, show us your draft defence.
