Hi, quick update Iv received my directions questionnaire and need to send this back.
I’m thinking about ticking yes for mediation with no intention of making an offer or something like £10. this might look better for my case in front of a judge?
Also there’s a box that says expert evidence - I’m pretty sure this is a No but i have taken advise here? Does this count?0 -

Hi, just posting a quick update and i also need some further advice.
I received the court date that should happen in June, not sure if i will be able to attend due to Covid but i will try, however BW legal have sent over their case and have said that no one will be attending court.
They have made a crucial error.. and I am hoping it is a slam dunk. I need to make sure that i use all the ammunition that i can.
Their case opens with the following sentence.
The Terms and conditions of the contractual licence by which users may use the private site include the following:
11.1 Permit Holders Only:
11.1.1 Only park in a numbered bay stated on your permit;
AND
11.1.2 Permits must be clearly displayed on dashboard/windscreen
11.2 No parking on roadway at any time.
I cant believe the idiot's, at the back the evidence / photo's show pictures of a sign... But that sign is completely different to the one in the car park lol. (there are actually two signs in the car park, 1 talks about permit required, another says no parking at any time)
Now some of the terms are still the same but the two in the car park are so vague and brief (I have highlighted in bold the bits that are missing from the actual signage). The real sign has no mention of bay's, roadway's, pavements or anything that you can or can't park in or on!!
Surely this is destroys their whole case as their main piece of evidence is incorrect? Any advise?
Also I have pictures of other vehicles parking in the same spot that i used, one vehicle is a pickup truck with Zenith property management decals all over it (company who owns / looks after the building). If it was such a crime then surely they would not park there themselves!!1 -
Also they have been sending out offers in the post of 25% due to Covid hahahah. I also received a phone call the other day from BW, no idea how they got my number but i refused to give them any details to go past 'security'. hope they are going bust!0

You need to read the Telephone Hearings thread from start to finish and do as advised there. I just posted a revised email to send to the courts (with your WS and evidence (and supplementary WS and evidence about 'abuse of process') and I just posted on that thread, a DRAFT ORDER to try to get cases struck out.

HELP PLEASE. URGENT.
I have just completed my WS with the court date 18/06/2020 and just referred back to my letter. It says the deadline was 29th April! My own stupid fault, I have just been super busy as I have had my first child.
I have tried to call the number all day but it just says its busy. What do i do???

Are you sure? Isn't that merely the date that the scammers had to pay the court fee?
Just email the WS and evidence to the local court & solicitor tonight anyway.

As an aside, I have NO IDEA why people always pick the phone up to try to ring courts. Leave them alone, they are busy... (it's not just you). Just do what you thought was required, and you will be within the usual 14 days. Include your summary costs assessment, and all your evidence like in the thread by @keypulse as a good example.
Get on with it, get off the phone...stay off the phone. You cannot deal with courts by phone. what do peple expect a clerk is going to tell them? Thanks for the speedy response, the claimant deadline was 21st May.
The letter (Notice of Allocation the the small claims track) reads;
The following paragraphs set out the judge's directions for preparation for the hearing. Failure to comply with the directions may result in the case having to be adjourned and the party at fault having to pay costs.
7. Each party must deliver to the other party and to the court offices copies of all documents on which that party intends to rely at the hearing no later than 31st March 2020.
My bad I thought it was 29th of April but this is even worse, why this so early from the hearing? Letter was sent 28th Feb.
I will send it over tonight and include mitigating circumstances just as a precaution.0 -

Put in the WS near the start that the pandemic lockdown caused you xxxxx issues and distress (ill relative? shielding? keyworker? home schooling?) and you got the Order in mid-March, in the midst of the initial lockdown anxiety and you honestly thought the deadline was not later than 14 days before the hearing, Apologise to the court and state that you don't believe the Claimant has been disadvantaged, as nothing you are submitting is news to them.PRIVATE 'PCN'?
