Done on my iPhone while Mrs U in the shops. Hopeless! I just don't know how some posters think they can go through the full process of appeal, defend, DQ, WS and evidence bundle all on a mobile phone. I couldn't get two sentences strung together properly.

    I've amended now, thanks LK.

Now back on my iPad. :)
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hi, OP here. I've been away and trying to handle this with just the help of a solicitor friend, but I feel like it is getting away from me. Hearing date is 28.08, so not far off. I hope that you will be generous enough to peruse what I have.
I am at WS stage and have today received the claimants WS and evidence. May I post here? If so, should I redact all personal stuff and any case identifying info?
I have a draft defence, but I am struggling with what is of most importance. I feel it is my side of the story, my friend wants to concentrate on the contractual side and whether the owners of the land are the same as the signers of the agreement.
    My head is befuddled. :(

Obviously you just read other WS and you'd see what to submit and how to show us their WS like this person has done, who has also left it to the last minute (sigh...):

Crack on and show us their WS even if you have to split all the evidence into two or three files like they did.  Read theirs first, please, plus the other WS examples that are in the NEWBIES thread, and the ones by @Chefdave (who also did his last minute!) and @Staatsgrenze who was assisted by me locally.

You do know your WS deadline was today at 4pm, as stated on your Order that set the hearing date?  Is it a telephone hearing?

The NoH states it is a remote hearing. (Skype). It says the bundle has to be sent by email no later than 48 hours before the hearing.
Should the WS have been submitted separately. That is no clearly stated in the order that sets the hearing date

Presumably you had the hearing date set a while back by a previous Order?

That one told all parties to exchange WS & evidence 'not later than' 14 days before the hearing.  A later order telling you that it's been converted to a phone hearing doesn't change your deadline from the original Hearing Order.

It was today. They've complied.  You haven't.  You are now late.

Crack on so that you can at least email all this to the local court and Claimant's solicitors by Monday at the latest - just like everyone else trying to play catch up this weekend.

On 17/7 I received a Notice of Allocation to the small claims track (hearing) and yes it does state in that, that documents should be sent no later than 14 days before the hearing, but there was no hearing date on that letter.
On 28/7 I received the notice of hearing with he hearing date and the information that documents should be supplied no later than 48 hours before the hearing. I assumed, wrongly it seems that it was that instruction I had to follow. I apologise. I did not want to be playing catch up, but I guess thats the situation I find myself in.

Yes, you are now late.  I showed you what to do and where to look, it's copy & paste stuff and your story in the WS (easy to write) and also tear their evidence apart in your WS.

This is a simple stage.  Loads of people play catch up and win.

Show us their WS & evidence first, like the other poster did and NOT JUST THEIR WS (please).
