Ok thanks,
Hopefully it will get back on track.
I am aware that the easiest route to all this is to get the proprietor to give me evidence that I am entitled to park, but sadly I believe this route has been exhausted without great success(other than the badly worded email I mentioned much earlier, which has been said (by PP) the writer of doesn't have authorization to authorize parking despite him being the landlord of the pub)
If someone can let me know if this is an LBC and if i should be providing them with my evidence within the 14 day period and asking them to consider ALL PCNs at this time, that would be really good.
Thanks in advance.0 -
See advice in post # 6 by Coupon-mad. A formal LBC/LBA/LOC/LBCC will give you 30 days to respond, will contain financial forms, which you don't fill I and should contain particulars of the claim with evidence they are going to rely on in court.1

I have read much of the LBC info on that page, yet I am still uncertain as to whether what I have is an LBC or not. There is a lot on that page that says that they will likely not provide all the info that is required as per PD. So how do i know if this is an official LBC really deficiaent in what is required, or another level of intimidation?
Also as per the pre action protocol, should I be responding to this letter (if it is just another level of intimidation and not an LBC) by siging up to bwlegals "Customer Portal" as the letter suggests, in order to dispute this and all other PCNs.
As a side note, I have now recieved from Prem Park the evidence (which I hope nails this case shut) of my previous vehicle having been registered on their virtual permit system.
I really want to try and nip this in the bud before it gets anymore formal and don't know whether to try communicating with bwlegal or not?
p.s,Today is day 14 of the 14 given to respond.
Advice appreciated.0 -
Nobody will read your letter. There's little or no human intervention until such time as this evolves into a real court case.I really want to try and nip this in the bud before it gets anymore formal and don't know whether to try communicating with bwlegal or not?
As has already been explained, unless you've been given 30 days to respond, this is not a formal LBC.Today is day 14 of the 14 given to respond. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I am officially an idiot.
I received my LBC on Mon23rd Dec ( I knew it would arrive just in time to dampen the Xmas spirit), but I put it to one side with the intention of dealing with it immediately post Christmas. In that 72 hour peirod the letter seems to have vanished from my home.
Having already hunted high and low, can anyone offer any advice on how to go about applying for a reprint? getting a copy sent?
I'm not even sure where it came from.
HELP Please....oh and Merry Christmas.0 -
If it was only a Letter of Claim, and not a County Court Claim Form, then it is not a major problem if you don't reply.
Yes, you really should reply, but it won't make much difference if you don't.
Are you sure it wasn't a County Court Claim Form from the County Court Business Centre in Northampton that you have mislaid?1 -
Do not fret. A LBC is not as important as a LoC. You can actually ignore the former but you must not ignore the latter.
Ideally you should respond to the LBC refuting the charge, but it will not affect the court case itself. The worse that can happen is the scammers or scamlicitors will whinge to the judge that you ignored it. All you have to do is tell the truth. It arrived during the chrymble festivities and got lost.
Did it get chucked out with half a tonne of wrapping paper? Did it get mislaid by the extended family that was visiting? Perhaps. So what?
Keep calm, enjoy the remaining few days of the Yuletide festival and wait for the LBC to arrive.I married my cousin. I had to...I don't have a sister.

Ok. thank you for your responses.
I have thankfully located the letter. And it is the County Court Claim Form that it was important to respond to.
So I now need to make my defense complete.
The main concern is that this Claim form is only for a couple of the 14 tickets that PP have served on me. I need to know how I get them to take all of them in to consideration at once. i only want to have to go through this process once!!
Assuming that my defense is sound, I want all of this to be squashed in one go.0 -
What you want is not relevant at the moment
You can only deal with what is in front of you for now
Post the issue date from the claim form below
Do the AOS if it arrived more than 5 days ago , online
Do not put anything in the defence box (note , no S in the word Defence)
Email a SAR to the DPO at the PPC today, attaching a copy of the claim form as proof of I D under the GDPR law
Then start drafting your defence1 -
I think 14 tickets would be an uphill struggle to defend. Defend the 2 you've got, then read about res judicata. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
