Brilliant news - despite your thread title ''Multiple tickets = Fear'' you got there in the end, with costs, and:
ANOTHER 13 PREMIER PARK ONES BITE THE DUST!
Can you remind us the exact location of this White Swan car park in case other posters come here with a claim about it. And could you please post a link to the landowner authority (the whole document) so we can see that clause that says the client is responsible for the permit registrations?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Was the judge stating that one can pick and choose between Section 43 & 44? In his case the contract was not made by an individual but by a company and surely then Section 44 is the overriding law.Fruitcake said:It seems a few scammers have recently started using S43 (Simple Contract) as a counter to S44 non compliance of the Companies Act. It is therefore necessary to ensure defendants are conversant with para 2 of S43,
(2) Any formalities required by law in the case of a contract made by an individual also apply, unless a contrary intention appears, to a contract made by or on behalf of a company.
Formalities required by law would include authority (and signatures) from the other party.5 -
Well done. I have attended CC several times (winning them all), but would be most uncomfortable with a telephone hearing.
Unfortunately judges just do not appreciate how long TMOTCO spends preparing for these cases. I recently fought an unfair bus lane ticket. I won at appeal, it took me several hours research, and several letters,. but compensation was deniedYou never know how far you can go until you go too far.3 -
Hi, I hope you have all had a pleasant festive season so far,
Sorry for the delay, but as requested by @Coupon-mad here (I hope) is a link to the full service agreement and car park signage in question.
https://documentcloud.adobe.com/link/review?uri=urn:aaid:scds:US:e2c6e5cb-6ffe-454c-b9bd-4bc1b26c28ff
The location was The White Swan in Hoddesdon, Herts.
The section 4.2 was cited by the Judge as contradicting the signage within the car park and the assertion by the Claimants that the Pub Managment had no authority to give permission to park (or cancel PCNs).
Thanks again.
All the best for 2021.5 -
Thanks for this! We will try to remember it for any future case about Premier Park infesting the White Swan in Hoddesdon.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
