Can you remind us the exact location of this White Swan car park in case other posters come here with a claim about it.  And could you please post a link to the landowner authority (the whole document) so we can see that clause that says the client is responsible for the permit registrations?

Was the judge stating that one can pick and choose between Section 43 & 44?  In his case the contract was not made by an individual but by a company and surely then Section 44 is the overriding law.

Well done.  I have attended CC  several times (winning them all), but would be most uncomfortable with a telephone hearing.

Unfortunately judges just do not appreciate how long TMOTCO spends preparing for these cases.  I recently fought an unfair bus lane ticket.  I won at appeal, it took me several hours research, and several letters,. but compensation was denied

The location was The White Swan in Hoddesdon, Herts. 
The section 4.2 was cited by the Judge as contradicting the signage within the car park and the assertion by the Claimants that the Pub Managment had no authority to give permission to park (or cancel PCNs).
