I'm not too sure about that.

I take issue with this bit:

Whilst that may or may not be true, the '3rd party' is not trying to create a contract between the landowner and the driver.

They, the PPC, assert that they have the right to form a contract between themselves and the driver.

If James1968's point was correct, the whole business model of the private parking companies would've collapsed years ago.

Indeed. Given the Supreme Court have somewhat disagreed with the reasoning you might struggle with those arguments.

... The appeals process was quite easy, except for the judge being an utter c**t, and it has now been struck off. ...

Certainly one of the parties in that court hearing was an utter c**t.

But I don't think it was the Judge.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

Your post makes no sense whatsoever. You say you've paid it, then say it's set aside then go on to say it's still on your record.

You can only have one of those options. You've either paid it or set it aside. If it's set aside then it's no longer on your record. If it's paid then it's over with.

What exactly happened. I love a good story.

I got issued a Parking Charge Notice which went unpaid. I didn't receive any paper work (to the best of my knowledge) to it went to court, of course I was unaware, then I got issued a CCJ. Which I only found out about over a month after. So I paid the solicitors then went to court to get it removed which they did do.

But wrong, as you have already found out!

You openly admit that you just want to abuse private property and the law as you wish.

You start multiple threads about which proves you a muppet:

Then come on here spouting utter rubbish and expect the regulars to help you out of trouble.

You are the very reason why PPC's exist and flourish to scam the more innocent victims that just make a mistake, unlike you that wants everything their own way.

Where's the abuse?? In parking in an unused visitor's bay for 1hr???

The threads before were for other parking fines which I got out of, by just ignoring all the tickets - which you are told not to do on here!

It was merely an anecdote of what happened last week. I thought this was for helping people wriggle out of parking fines. If I'd have known everyone would take the moral high ground I would have just taken the f**king bus! :rotfl::rotfl:

Then you don't have a ccj. What's the problem?

Hey mate, Because I was just wondering what defences there were for people that have parked on private land, so it doesn't go to court again. But the defences on here are not ones that look like they hold up in court.

Each case turns on its own facts. Until you get a claim you don't know the facts. With that in mind you cannot construct a defence for a claim that does not yet exist.
