  • Thanks Redx - I am finding it a nightmare to walk the line between telling the Judge "what happened" and keeping it as brief and concise as possible! I had an idea, maybe write my WS FIRST!! Then pull the salient bits out for brief defence points. May as well try, so far 5 different attempts at Defence haven't gone too well! You're right though I am sure, when I left the desk I thought "haven't I just written a WS?" :D

Meanie - got your PM and replied. thanks

Yep, I agree, I didn't see anything wrong with it and it did tell the judge what you wanted to say, but as your WS, which is the correct time to do so

Then as you say, use salient points to draft a defence which concentrates on the legal arguments etc and not kids being ill etc

Sounds like a good plan to me
  • Your input is much appreciated Redx

Well, interesting chat with someone today. Parking attendant: "My company used to have the contract for that car park. But people kept going into the Museum to complain when finding a PCN on their car, after being held up in queues in the Museum etc. So the Museum decided to do away with attendant stick and run types, and changed the contract in order to use ANPR so that people didn't get any idea of a PCN until a week or two later, usually long after they returned home from holidays down here".

5NEAKY BA5TARD5. I did half consider asking for a WS from him, but he would say no and I doubt Judges would care anyway. But interesting, all the same.

I searched that doc for "nursing" and "mother" - no results.
    Search instead for "breast-feeding".

Check out this link where you will find the below quote on page 4: -
A business cannot discriminate against mothers who are breastfeeding a child of any age.
The Equality Act 2010 has specifically clarified that it is unlawful for a business to discriminate against a woman because she is breastfeeding a child.
Other information will be available throughout that article.
  • Doh, I really tried hard to find it before posting. Sorry, and thank you. That's pretty thin (I think), but just about thick enough to refer to!

  • Defence has been submitted, 31 minutes before the deadline, not a deliberate choice, but the raised pulse while I fixed my scanner provided some temporary excitement. Not!

I doubt there is any point me chasing anything? I got the receipt email confirming it was received.

One question I have regarding the next steps - is it worth waiting a little while before spending hours on the WS and skeleton? (In case the claim is dropped or struck out? Not hopeful of that of course, but it's possible.)

Thanks to everyone for the excellent and generous guidance.

Have you filed a copy of the defence with the claimant as well as the court?

No need at defence stage. MCOL does that!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
