BW Legal - Any help very much appreciated...

- BWL issued a LoC, non compliant with CPR (PD) and non compliant with POFA.
- Use of ANPR was not advertised, contravening BPA CoP
- Had it been advertised, no PCN would have been issued, as childcare issues would have been taken out of car park. Ticket paid for 2 hours, parked less than 2 hours, but took another 25 mins (ish) to leave due to childcare issues, driver assumed safe to do so due to complete lack of ANPR signs.
- Defence submitted.
- WS and Exhibits submitted. Hearing 7th Feb 2019. Unsure about Skeleton.

You really don't need to post all those letters or all that. We have seen those standard letters before
Just read the newbies thread and it tells you what you need to do.0 -

The first thing for you to do is PARAGRAPH your post
Most people will not read a wall of text.
Then you read the NEWBIES thread
And you can read all about the timewasting fools, DRP and Zenith
who are total idiots
https://forums.moneysavingexpert.com/discussion/5859454debt+collectors+drp
Then read all about BWLegal, a pretend legal firm who adore
wasting their money

As there are so few paragraphs I have not read this, I suspect that others will feel the same, so please remedy this.
They are obviously trying to scam you so complain to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.
Until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. eAYou never know how far you can go until you go too far.0 -
Firstly THANK YOU for the replies. Secondly, it seems I overdid the detail. SORRY. I read quite a few threads and found loads where people were (rightly) criticised for not including enough detail! I therefore thought more is better, clearly not! I have adjusted my post to remove anything unnecessary and shorten it somewhat, as I really do want people to read it as I have to make decisions here on how to proceed and I will base that decision on people's thoughts on my case, the more the better.
I will have a read of those threads, thanks again for the replies.Combatting the pandemic of BWLegal-19, one 'notice of discontinuance' at a time. :-)0 -
All the DRP and Zenith letters can be deleted.
Surely you read in post #4 of the NEWBIES thread that debt collectors letters can be ignored? They are of no interest to anyone.0 -
Will delete those then thanks. I am trying my best here pal. I haven't read that thread yet but will do shortly and will be suitable informed once I have. I just don't want to omit details only to annoy people by not providing enough detail to answer my query. Also my past experiences (years) with DCAs from credit card companies taught me that it isn't an exact science to determine whether a company name represents a LAW firm or a DCA, they often lie and cheat, and some run both outfits within their brand. So forgive me, I will delete those now. ThanksCombatting the pandemic of BWLegal-19, one 'notice of discontinuance' at a time. :-)0

I have read the newbie thread. The first post was a bit tricky to follow (not a fault with the post, more with my ability to work out where I fit into it!)
The second post was great and I THINK my next steps should be to put BW on hold (is that an acknowledgement of service letter?) and then SAR the parking company. That seems like first base here? There was mention of “complaints” further down that post, but no mention of it beforehand. Should I be complaining to someone at this stage? Or save the circumstances (ticket bought and returned to van, child underwear explosion, changed, settled, breastfed before leaving (NOT while in parking space) for a court defence?
“Second stage appeal - POPLA or IAS” - What is “second stage”? Where am I in the stages, I have a LOC. Should Popla be something I look into or is that no use to me at the stage I am at? We have never received a NTK.
After reading more threads I get the feeling I am well beyond virtually all of the stages which are advised about in the newbie thread. If I am at the court stage, I will just go and fight the shysters in court. I don’t lack confidence about doing that (nor am I arrogant or assuming I will win, but fight I WILL!), what I am nervous about is making a mistake in procedure or some other error which scuppers my chances at court. If anyone who has been to court with BW would care to chip in, please do!
I am currently reading Bargepole’s excellent post at the start of this thread - https://forums.moneysavingexpert.com/discussion/5546325/court-claim-procedure-updated-october-2016 so I think that will help a great deal.
Thanks very much everyone, looks like it’s time to prepare for court.Combatting the pandemic of BWLegal-19, one 'notice of discontinuance' at a time. :-)0 -
Having read post #4 of the NEWBIES thread, you need now to be reading post #2 of that thread.
You can ignore post #3 of the NEWBIES thread as you are well past any possible 'second stage appeal'.
You are right - put BWL on hold and send a SAR to the PPC.
But it's not the Acknowledgement of Service - that comes after you have received a County Court Claim Form.
As you say, you should be following the process outlined in post #2 of the NEWBIES thread and thinking about the almost inevitable court claim.0 -
If you had done the 'right' thing (as per forum advice) and appealed, you'd have been offered POPLA. You didn't appeal so none of that applies. It's far too late for appeal now.“Second stage appeal - POPLA or IAS” - What is “second stage”? Where am I in the stages, I have a LOC.
Yes you now have the right post - the second one - in the NEWBIES thread is your stage. No-one cares about debt collector letters at all, irrelevant trash.
The only thing I now add to the advice about when sending a PPC a SAR by email, is that when you also email BW Legal, tell them you are 'seeking debt advice' which gets you the 30 days grace you need to get the SAR results back, before the court claim arrives.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
