Of course, I'm coming from the smug position of never having had a parking fine, or speeding ticket, so maybe I'm not best placed to comment.

Ditto - however, there are occasions when, despite my best will and effort, I do contravene minor driving laws (see earlier post). It terrifies me! I'm obsessed with driving perfectly, but I could be unlucky enough to end up in the OP's situation one day despite being the most compliant driver I know.

So where are the limits? Is it right that, occasionally, an angel should be punished for something almost unavoidable (not suggesting this is OP, but could be in my potential future case); or should focus be on the genuinely dangerous and inconsiderate growing minority?

  • I'm not claiming to be an angel but i can honestly say that i'm a careful driver and try to obey the law as much as i can. Especially in town driving like this where these box junctions actually do have a meaning to be there!

Precisely from this fact, i would never commit such a traffic offence knowingly.

So even if i was at fault there and even if i entered the junction without clear indication that i could exit it, i am confident that i didn't intend to do it, and my conscience is clear in appealing against it.

Therefore my decision is to appeal, so all i need now is some help in gathering my letter.

I'd appreciate if anyone can help doing this. I'll go there in the weekend and take some pictures just in case. I will appeal mainly on the grounds that the box junction markings were not done by the rules, but i'll also state that i would need to see their video proof.

On another note, the letter is addressed to the owner of the vehicle, who is my wife, and i called to ask them how the appeal can be done.

The way it works is, i will indicate that i was the owner and describe what happened as far as i can remember. She then will write the appeal on these grounds and sign it. Just thought i should inform you all in case you are faced with a similar problem in the future.

    I hope you get hammered

You broke the law, you got caught

People who block junctions are part of the reason traffic in this country is so bad, Im glad those whose do it and dont seem to see the wrong in it are punished

Its a shame it doesnt attract points also

The Highway Code isn't the law.

If you read the introduction to the Highway Code it says the following:-

Many of the rules in the Code are legal requirements, and if you disobey these rules you are committing a criminal offence. You may be fined, given penalty points on your licence or be disqualified from driving. In the most serious cases you may be sent to prison. Such rules are identified by the use of the words ‘MUST/MUST NOT’.

Rule 174 has the words MUST NOT and is therefore a legal requirement.

Looking at that photo I would not think there is a leg to stand on, it is obvious that the exit was not clear before he entered the junction and as for the rubbish about the road markings that carriageway is two lanes of traffic merging into one, the junction is correctly marked.

    .

In the second case there is a clear space on the far side so you enter the box. Something (and I struggle to think of a good example) happens to fill that clear space before you reach it, so you are stranded. In this case you shouldn't be prosecuted in my view.

There could be a very simple reason the gap the car infront of you leaves between them and the car infront of them is very large. This means that all or part of your vehicle is stuck in the box junction when the lights change.

Luckily this has only happened to me and 2 of my friends' when I've been with them when there have been no cameras.

On 2 of the 3 occassions this happened the driver causing the obstruction was on the phone. On the other occassion my friend and myself couldn't find a cause as the driver of the other car hadn't left such a large gap before or after following them into the box junction. (Highway code 151 )
    I'm not cynical I'm realistic :p

(If a link I give opens pop ups I won't know I don't use windows)

but you wont because your "precence" cases are completely different and their actions were outwith their control, yours was completely avoidable if you'd been patient

Its blatant from the pic you were impatient and got caught out

I hope they charge you for an increased crime for wasting everyones time and resources

I think you're confusing two things, there's nothing wrong about two lanes merging into one. I mentioned that when talking about the situation saying the traffic might stop unexpectedly in this situation because when two lanes merge, the cars at the back of the single lane have to give each other way as they merge into one lane.

When i talked about the markings being wrong, i didn't mean that, what i meant was the yellow box markings were wrong.

Please have a read THIS if you are not sure.
