Why is it relevant to this thread (which is about mobile affiliates, not dialamobile)
Contracts with mobile affiliates were taken out on line, and all their customers were well aware that a penalty would be imposed should they cancel their contracts prior to the expiry of the minimum period.
But thanks to friendlywatchdog's post, CISAS are telling people the penalty term in the contract no longer applies. I will complain to CISAS and see if I can quite T-mobile early (thanks friendlywatchdog).0 -

I didnt take the £150 offer when it was going, then wont give 2 me back again ...

You have misunderstood.
Customers of dialamobile got their contracts in store. They weren't given any ts + cs for their contracts.
Hence CISAS are saying there is no penalty clause to enforce as the customers concerned were never given any contracts to agree to.
This was not so for the customers of mobile affiliates!0 -

My Name is Gus and I have been helping customer of different in-direct agents whose principals are the Mobile Network Operators and that the customers with whom they have a binding contract. I also understand that there was a different binding contracts with the agents themselves who have at some point broken the terms or broken the agreement by using unfair terms.
1) Priceshock forum has a number of templates and a complaint letter to Cisas. Though it is not managed by me all most all templates are created by myself and I have helped some customers to come out of the contract because I considered the evidence and information in front of me and concluded in favour of the customer.
2) I have been dealing with a number of cases between the MNO (Respondents) and the customer (Claimant) in front of Cisas. I have found in most cases that the Service Provider on the ball and filing all agreements including the cash back (in regards to dialamobile (in particular)).
3) It should be considered a term that is written and its effect or meaning should be understood as how a consumer would understand it even if that was not the effect intended by the writer.
4) Unfair terms or terms specifically designed to limit ones responsibility or lawful duty are of no effect.

Still no chance of a payout according to the administrator. Dextra who seem to have been the distributor for most of these companies seem to continue to take the p*ss claiming that they do not owe any commissions (see also phones2udirect administration)
Also Customs and Excise seem to be claiming that vat is payable on cashbacks previously paid. Not much of an issue in this case but possibly of relevance to cashback companies still trading?
I have also been looking at CISAS and they seem consistently against customers who have tried to suggest that the network provider should be held responsible if their agent, the retailer, fails to meet the promised cash-back payments. Possibly this is legally correct but it seems highly doubtful to me that the networks did not benefit greatly from the extra contracts that would not otherwise have been sold and must have been aware that the business model did not stack up...I think....0 -
I started a 12 month contract with Cool New Mobile last July on Vodafone. When CNM went bankrupt Vodafone offered me a half price contract which i accepted in November. Today i phoned up to cancel my contract to be told that by accepting the half price line rental it increased the length of my contract till November 08. Has anyone else has any experience with this? is there a way to get out of the contract?0

This happened to a lot of people I think. Unless you specified it or argued with them they simply extended the contract.
I would argue it with them & say you were at no point told about the extension. If the person you spoke to didn't mention it then you have a good case to get them to cancel. I'd write a letter saying this and ask for a recording of the call from them.Wondering how to have a life & not rack up more debts...0 -
One of my lot did exactly the same at exactly the same times with the same result - except they have successfully cancelled at the end of the original 12 months by giving the written notice I advised them to give. Write, don't phone; Vodafone are now extremely BAD as far as customer "service" is concerned. Eight months ago I praised them; no longer!0

Don't know if this helps but found that you can make claims directly to the administrators. The company used to be trading under several different names, including cool new mobile and phoneboxdirect. Worth looking at as well for the claims:

That was clear in November actually. Don't hold you breath for anything at all - that was clear then too. When a cashback dealer goes bust don't waste time and emotion - move on.0
