  • I have been watching this thread carefully for some months now and have participated once or twice. Have I interpreted he situation correctly in the following:

    There is some sort of private group, off this forum, which I may join. If so, how do I do this?
    In our case the solicitors sent a paper which invited responses prior to action. We made responses by email which included asking some questions. Several wees after the final date for submission of these responses we have received no communication from the pursuers, not even an acknowledgement of the email. Should we take any action now?

    We plan to travel extensively this winter for many weeks. Should we take any action to avoid a claimn happening while we are out of the country?

    Send them a follow-up and remind them of the requirements to 'narrow the issues' prior to any court hearing, so you need a full response from them.

    You can't avoid that (and especially don't inform the claimants of absences, because, guess what .....?), so you do need to have someone looking after your post, as if you don't respond to a claim within 19 days of the date of issue, you lose automatically, and if you're still out of the country behind 4 weeks of the judgment in default, you've got a very nasty CCJ trashing your credit for the following 6 years.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    On the back of what Chris said in BWLegals witness statement for me they have tried to include signage as evidence, which is not present on the date of the contravention
    Although you cannot read the sign it is apparent that it didnt exist ... total numptys, id double check any of their submitted evidence

    Absolutely you MUST trash their WS if it includes evidence thats so obviously misleading. Point out htat, as the author isnt there, the rest of the WS must be viewed with suspicion.

    Add another to your score sheet guys ,I didnt even speak a word and the case was dismissed. Apologies in advance if the detail isnt there my anxiety was through the roof.

    So i sat in the waiting chairs about 5 mins before the case BWlegals rep walks in. She speaks to me - seems pleasant enough and tries to ask if we can come to an agreement before going in - to which i responded "Yes , UKPPO can pay me" , Fair to say the convo was cut short and finished with " i think it would be best anything else is kept for in front of the judge"

    Anyways we go in, I wish the judge a good afternoon and take my seat by this point my leg is going beserk and im fidgeting.
    Judge opens with essentially - ok where does it say that UKPPO has the right to enforce byelaws , i can see a copy of the contract but no mention.
    The rep is scrambling in her papers and says it should be here .. after a few mins scuffling she asks for a 5 min breather to speak to mothership - we leave the room.

    We go back in and after a short chat with the woman next to me in the waiting room who is also taking these c*nts on we go back in.

    She points to an extract in byelaws mentioning that all " blah blah blah and sub-contracters can enforce byelaws" - UKPPO is a sub contractor

    Judge asks where is the evidence that UKPPO is hired as a subcontractor and Boom Nothing. Nada. they have fudge all mentioned anywhere.

    Case is dismissed and asked if there is anything anyone would like to add in which i sheepishly pipe up and speak my 2nd short sentence "Yes i have my schedule of costs" which gets awarded for the ordinary costs but unfortunately my added litigation is struck off as there was no evidence of unreasonable behaviour ( there was but tbh i wasnt going to pipe up i was happy to just be done and dusted)

    Money in my back pocket and a sense of pride as i walk out the room head held high that ive won without saying a word.

    To Gloria ( i dont think her names Gloria but she looked like one ) if you're on here you've got this.

    And to the Forum a heartfelt thank you , it may have only been 300 quid worst case but its money i could have done without paying

    finally to the rest of you, take those f*ckers down. Might go park up at the airport again for a laugh

    To give you an idea of timescales - the cases currently in the WhatsApp group received letters of claim in late Oct 2018 - then nothing until county court business centre claim forms dated 15 Feb 2019 - so you may be waiting a few months for the next step.

    The group is for those currently waiting for hearings from the February claim forms- about 10 months further in the process than your case.

    Anymore useful info we find will be posted here - if it’s not already covered in the newbies thread.

  • 9-0 for the group today, again contract based. Newcastle county Court - Case dismissed, no contract to enforce byelaws . Park & Fly and Newcastle Park & Fly not the same company. 3rd Newcastle Airport case today where case was thrown out for the same reason. Took less than 5 minutes.

    Assume one of the 3 must have been SunTemple as they are not a group member!
