Definitely not halftime yet.
Keep them coming. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hi Guys - I posted some time ago , im not part of the whatsapp group but just need a quick hand. I read a comment earlier in the posts about Airport Byelaws only being enforced in magistrates court but also that there is only 6 month from alleged offence for it to be enforced but im having a hard time finding the official guidelines on this to slot into an ammended defence to bring on the day.
I'm due in court tuesday afternoon and will let you know how i get on, as all your help (even on other posts) has me rareing to go to take these Tw*ts on
Cheers in advance0 -
You can not bring an amended defence with you on the day..........0

Sorry i think i've used the wrong terminology, its more an expansion of what ive said already rather than actually amending my defence. Bwlegal in my opinion played a very underhanded tactic and sent their witness statements which arrived a day before the cutoff.
Upon reading it, i noticed the PCN was issued due to "Breach of Byelaws" which from what i gather isnt enforceable by themselves and is also in the wrong track of court ?0 -
It's in the Magistrates Court Act 1980. It gives timescales for various prosecutions. A minor offence has to have information laid before the court within 6 months.0

Have a look at the pic of when incident took place if there were no signs at or just before barrier -therefore no contract. The only sign was past barrier so unreadable. This was pre 2019 approx.
In their witness statement they have pics of signage that were put up at barrier to hilton only THIS YEAR. Sneaky false evidence. No signs no contract0 -
This is what I think ukppo have done-
They have put up a slow barrier forcing people to stop than accusing them of breaking bylaw for stopping .signs deliberately located wrong location not near barrier . Than 3 or more years later when legislation will stop them from threat0 -
to people they change entrance and put up signs 2019 at barrier to comply with bpa rules and than with new pics of 2019 signs take hundreds to court with these irre0

irrelevant pics of new signs 2019. So dishonest . sorry for confusing post I'm new to this0
