  • 5-0 Unexpected discontinuance received after submitting a comprehensive WS - hopefully others may follow.
  • 6-0 the group actually received notice of 2 discontinued claims today.
  • Have just won on 23.8.19 a 'stopping case' vs UK Parking at Newcastle Airport.

    District Judge Phillips ruled that UKP were acting as agents for Newcastle Airport and therefore should not be bringing the case in their own name. Case dismissed, with costs that I'll enjoy spending

    He also indicated strongly that the signage was confusing, was not necessarily at the entrance to the restricted zone and could not be read without stopping (a Catch 22 situation).

    Hopefully this case is why UKP are now rethinking pending cases??

  • I think they have worked out they are better off just scamming the people who are frightened by scary letters from scu8mcos...court cases and publicity on here will actually reduce their scumco income a more people will find it and be able to defend against their predatory practices.

    I have been following posts on this forum for some months as my wife's case progresses. Currently she awaits a response to a Claim Before Action which expired a month ago today. She responded asking for a copy of Airport Bylaws and advising the company that she was not driving.

    As part of my action against this insidious practice I wrote to my MP who has three times passed letters to the minister. For any substantial change to take place in my view the minister needs to take more seriously how airport bylaws are being used to puursue people for money in a completely unacceptable manner.

    I realise it's asking people to take on something which may not directly affect their case but it is time MPs took effective action.

    In my last letter to my MP I made the following points:

    1. The bylaws are only applicable to restricted areas but there appears to be an attempt to use them when pursuing people for charges on public roads.
    2. A parking charge is a civil debt therefore it cannot be pursued using bylaws unless it is pursued ion the correct court.
    3. The claimed debt is in respect of a charge based on a contract which relies on notices advising a driver of the conditions of contract. These notices are badly positioned and not of a size which is readable.

    I know this is far from all of the alleged abuses and I'm sure there are people on here more capable of briefing an MP. You can find yours by Googling your constituency name and ask the MP contact details.

    I've suggested the following action might be appropriate:

    1. Voluntary control through a code of conduct needs replacing with strict regulation
    2. Companies using these methods should be subject to penalties.
    3. Airport Regulations should deal with specific issues of stopping and parking, notices and penalty handling.

    I URGE EVERYONE TO EMAIL THEIR MP

    Unfortunately, MPs have far more important things to do at the moment ... mainly trying to protect their own jobs. ;)
  • Another 3 wins at Newcastle airport at South Shields County Court. I was helping with one case and submitted a skeleton. There were two other cases and judge decided to hear all three together. He used our skeleton to rule on all three - that there was no proof of contract between UKPP and Newcastle Airport and dismissed them all.
