    The recommended way forward for THESE CASES ABOUT AN AIRPORT (or any case about a Railway car park where railway byelaws apply) is to pay £100 court fee and CONTEST JURISDICTION (when you get a claim form) using the 'contest jurisdiction' wording carefully written and posted earlier on this thread (no, I don't know the post number, I just recall helping with it and using bargepole's words to create it).

    For newbies with non-byelaws claims, this thread does NOT apply to your case.

  • Good evening all, I have received my letter informing me that it has now been passed to the legal team. I have so far not acknowledged any letters but think now may be the time to contest. From what I gather the route of procedure being to contest jurisdiction? Could someone please lay this out in Lehman’s terms as this is not an area which I’m very savvy on how to pursue it from here. Also the ways and means of joining said WhatsApp group would be much appreciated. Also does anyone to there knowledge know if they are actually winning any cases in court?
    Appreciate any advice on the subject I have read the thread but struggling to make head from rail for the most part.

  • Does anyone have a copy of the transcripts from the appeal of VCS vs Damen Ward 2018?

    BWL are referencing this case (among others) in their witness statements.

    I've tried a google search and forum search but no luck.

    There was a link in the Richieboy56 thread #195 that no longer works.

    I've also asked if Timyteague can share theirs as they appear to have received a copy.

    BWL state:

    "In this case, his honour judge Saffman decided that: It seems to me to be equally clear that there is consideration. The consideration is the license to use these private roads, in the same way as the consideration in Beavis was the license to park the car."

    It can be argued that there was no consideration as there was no entrance sign to the site at the time - but it's a bit like flying blind without the transcript in case there is anything else relevant.

    They also reference VCS v Crutchley but I've located that on Pepipoo.

    And of course Beavis transcript is readily available.

  • BWL reference this in all their no stopping cases, together with Crutchley. It's important you distinguish the circumstances of the current cases from those in Crutchley and Ward. It shouldn't be too hard, given that the road in front of the Marriot is outside the bylaw perimeter, not subject to bylaws and is, in fact, a public road. (zoom in on the map provided in the Newcastle Airport website) Any inside the perimeter would be subject to bylaws and the alleged contravention was a breach of those bylaws. In the case of Crutchley and Ward, the alleged breach was contractual and thus distinguished. If you can distinguish, Crutchley and Ward become irrelevant.
  • Ukppo took me to county court doubletree hotel 6.3 byelaw allegation at barrier. For those with similar alligation dating from over year ago or longer I'll give you the course I took thanks to posts on this website.
    First ask if byelaw or contract issue.
    If byelaw state magistrates court and 6 month time out. Also money doesn't go to private hands as stated on forum .
    If contract as Claimant stated than say they have changed the initial claim if byelaw 6.3. Also closely inspect their witness photos of signage and your car picture when incident took place. There will probably be no signage prior or at barrier. Therefore NO CONTRACT .
