County Court Claim Vehicle Control Services VCS

Hello,

I have received a county court claim from VCS and, after following the advice on the newbies thread, I am starting a thread.

Thus far I have filed an AOS and have read a few cases. The idea of defending on the basis of a hybrid PCN is intriguing and seems to be my best shot.

No admission of the driver has been made and this is related to a contravention from March 2019.

The claim is for parking at a railway station in a disabled space without displaying a valid disabled badge.

    I have also made a SAR, but only did that today. The claim was issued 5 days ago.
    I don't recall receiving any Letter Before Court Action letter

    was this in england and wales , or elsewhere ?


    are bylaws in place for this train station ?


    or is it just a private car park NEAR a train station ?

    No bye-laws that I'm aware of.

    It's the station's car park, not a private car park near the station, the station is Sandwell and Dudley if that helps.

    if its a station car park, and not one near a station , then bylaws apply


    bylaws issues are different than private parking issues , hence my question


    the replies you will get regarding advice will vary dependent if bylaws are in place or not


    if its railway land , then bylaws apply

    if bylaws apply due to NETWORK RAIL owning the land and leasing it to a TOC, then you may want to pay for and contest jurisdiction , as seen in this UKPPO airport thread

    however, if its private land then its not train station land, it cannot be both , meaning VCS are contracted by a landowner or M.A. , not the TOC and so no bylaws will apply

    What is the Issue Date on your Claim Form?

    Did it come from the County Court Business Centre in Northampton, or from somewhere else?

    So they can't use POFA which is the only way they can win given that I haven't decalred the driver.... So I'm not liable? So defending the case will be a doddle?
