County Court Claim Vehicle Control Services VCS

Is that fee refundable on winning?
Will try calling them tomorrow
However I did read earlier today, in this post about how the Claimant freely volunteered to pay the Defendant's costs, including that £100, just avoid the case going to the magistrates court.0 -
so did I , which was why I mentioned it on page 1 and also linked that UKPPO for the OP to study, because its the only time I have seen one mentioned that had them ducking out the back0
-
I will pay the £100 and contest jurisdiction, happy to be the guinea pig.
Just emailed them now so I have a paper record, will call in the morning0 -
I fear there may be an issue. Unless jurisdiction was contested with the Acknowledgment of Service the o/p may have, in effect, consented to the Court hearing this claim.
As such if an application is to be made that this should be dealt with by the Mags Court (I know nothing about byelaws) it's probably a good idea to do it promptly.
See the link below, for more info (different circumstances but addresses the broad point):

that is what worried me once the OP said they had already done the AOS in the standard format, whereas now its trying to undo what has already been done , like missing a turn off on the motorway and reversing in the slow lane , fraught with danger and possibly too late , meaning the OP may need to stay on the motorway and take their chances in civil court
act in haste , repent at leisure0 -
Just spoke to the ccbc apparently it doesn't matter that I failed to tick the box about contesting jurisdiction.
All I need to do is submit an "N244 Claim Form" within 14 days.0 -
Good info, this is how we learn the ropes to advise others about this aspect of a complicated topic
Please let us know how you get on0 -
Hence post #25...
if an application is to be made (N244) do it promptly (i.e. within 14 days).
Good luck with it!0 -
How do you feel about me contacting the claimant to inform them of my intentions?
They might close the case prematurely?
That'll save us both paying any extra money.0 -
I don't see why not, treat it as an LoC but do not miss the 14 day deadline which is running out fast0
