Sold the Wrong Car

  • I don’t know if I’m not making myself clear/or your not understanding where I am coming from?

    Brought a car online (from a dealership) no I didn’t test drive it or view (very common nowadays). Spoke directly to salesman, went through details over the phone and email, done all my checks as if you were face to face. The contract/receipts all state BMW 220i, which was produced by the dealership and Lombard.

    The Car arrived (from a third party delivery driver) - I signed for the delivery of the car which states 220i. The bloke who delivered it got picked up, by a colleague 10 minutes after. The documents was in the car, once I noticed it was a 218i I raised it with Lombard.

    They obviously had to do some research and didn’t get back to me until the following day. They were chasing the dealership but have never came across this sort of occurrence.
    I have mentioned that this vehicle is not the one I intended of purchasing and they openly admitted that they didn’t know what to do next.

    I gave them two options to either collect the vehicle or see what the dealership could offer me.

    Obviously they want the sale so they went off to contact the dealership. I chased Lombard (as this is who my agreement is with) for two months, awaiting a response from the dealership... contacting them a few times a week. They know I am using this vehicle during this period.

    After those two months I went to the dealership directly, back and forth a few times about the situation. They mention my agreement is with Lombard which is correct and I should go through them.

    After another period of a few months we are at the stage where the dealership is now asking what I want? (Probably just wants me to go away)

    I am trying to find out my options, is it a possibility of giving the car back? Or realistically I am just going to get x amount off of the car? Or just a free couple of services?

    I understand that this is an unusual case, probably missing some information out.

    The whole concept of viewing the car and test driving it would of save me this hassle absolutely but I didn’t do that, it was a reputable dealership.

    I always maintained that unless an agreement is resolved that I do not want this vehicle.

    You bought the car online and a third party brought it to you.
  • The car was advertised as a 220i with the subsequent documents signed prior to receiving the vehicle. I did not test drive or view this vehicle. When it arrived it was a 218i! You seemed to think you know the situation better than me
  • Yes the delivery was outsourced from Lombard

    I bought a car unseen once and it was delivered to me


    on arrival it clearly wasnt exactly as advertised. I refused to accept it until I had spoken to the dealer and the issues were sorted, It was booked in to a local dealer before I signed for it otherwise it would have stayed on the transporter.


    It wasnt a different car but the principal is the same


    hindsight is a wonderful thing, but you should have inspected it and refused to sign for it

    I would have thought the dealership should be refunding the different between a 220i and a 218i. No idea how much that would be though..
  • Having a quick look on Autotrader, the difference in price is £2,000 or £3,000 ! I'd be kicking up a bigger fuss, not emailing them every few days, especially after 6 months.

    I would ask them to collect the car and source one elsewhere, the result being a free car for six months.

    They may come back with a counter offer, but you have to start high.

    Did you know BEFORE agreeing to buy it that the advert was wrong, and the car was badged as a 218i?

    It's a very simple yes or no, but you seem to be dancing around it.

    Have i missed something re the advert.


    I thought the ad was for a 220, the Op bought a 220 but ended up with a 218.
