Sold the Wrong Car

Brought a car online (from a dealership) Your first post says that it is a BMW AUC bought from a main dealer. no I didn’t test drive it or view (very common nowadays Sorry but I don't know anyone who has parted with money without driving the car first.). Spoke directly to salesman, went through details over the phone and email, done all my checks as if you were face to face. The contract/receipts all state BMW 220i, which was produced by the dealership and Lombard.
The Car arrived (from a third party delivery driver) - I signed for the delivery of the car which states 220i. The bloke who delivered it got picked up, by a colleague 10 minutes after. The documents was in the car, once I noticed it was a 218i I raised it with Lombard. Why did you raise it with Lombard first and not the dealer? You had a purchase agreement with the dealer and a totally separate HP agreement with Lombard; quote from the Lombard website: Straightforward finance for a car or van you found yourself at a dealer. Any reason why when buying from a BMW manin dealer you chose not to use BMW's own finance?
I gave them two options to either collect the vehicle or see what the dealership could offer me. Why would Lombard collect the vehicle as they only provided the finance?
Obviously they want the sale so they went off to contact the dealership. I chased Lombard (as this is who my agreement is with but that is only your finance agreement) for two months, awaiting a response from the dealership... contacting them a few times a week. They know I am using this vehicle during this period.
After those two months I went to the dealership directly, back and forth a few times about the situation. They mention my agreement is with Lombard which is correct and I should go through them. Sounds like you got to talk to somebody who gave you the wrong advice as this dispute is between you and the dealership and all Lombard are interested in is getting their monthly payments.
After another period of a few months we are at the stage where the dealership is now asking what I want? (Probably just wants me to go away) Have you told them what you want?
I am trying to find out my options, is it a possibility of giving the car back? Or realistically I am just going to get x amount off of the car? Or just a free couple of services?
I would think that after 6 months your options are very limited:
a) you could return the car and be charged for 6 months use, depreciation, etc.
b) you could return that car and hope that the dealer offsets any price difference between the 218 and 220 against the costs in a)
c) you could keep the car and try to get the price difference between the 218 and 220 at the time of purchase as a refund
d) I'd not accept "free" services as the onboard systems can easily be updated to say that a service has been done.0 -
Are you trying to say that you accepted the delivery before noticing it was the wrong car? That your thorough inspection missed the 218i badge? On discovering it was wrong, why didn't you take it straight to the dealership?
It sounded like you knew it was the wrong one when you signed for it, in the hope of getting a huge discount on it.
Do you know if it was the advert that was wrong, or it was a different car? Do the registration, paperwork and spec all match apart from the engine?
If it was me, I'd have told the delivery driver to sod off, or left the car on the dealers forecourt instead of playing phone ping pong for 6 months.
Never buy a car unseen unless you're going over it with a microscope.0 -

Ok I still dont understand why you wouldn't check the car before you signed for it, were you hassled to sign for it ?

Only viewed and drove on the day I handed over the cash.

It does seem fairly common. Most threads on here that want help with a problem vehicle seem to mention they bought a car they didn't view.0 -

Whether he sussed it was the wrong car before, during or after it was delivered isn't really relevant, the fact remains he hasn't got the car he thought he was getting and so he's the one that must decide what he now wants. As I've already advised he needs to speak to BMW customer services and remind Lombard that they are equally liable with the dealer for any breach of contract.0 -

Before delivery, he had the opportunity to reject it.
Even after delivery, he had 14 days to reject it as a distance sale.
And even more relevant is whether he sussed before agreeing to buy.0
