Just to clear things up I knew straight away that it was a 218i, it has the badge on the back. And you can certainly tell the difference between a 1.5 and a 2l when driving. How no one spotted it is beyond me!
My previous lease ran out so I need a car. I was a little naive and knew all the paperwork and advertisement was wrong so I thought they didn’t have a leg to stand on if I returned the car. I explicitly told them that this would need to be resolved... however after speaking to numerous people from Lombard I went straight to the Dealership. I have been chasing this up monthly.
I had the choice to refused the car at the beginning however I chose it was in the best interest for myself to take it in the hope it would be resolved.
So you bought the right car that was mis advertised.0 -
I brought the car from their website, I didn’t test drive it or view it in person. I thought I made that clear but obviously not. I test drove a similar 220i nearer to home (I purchase the one online as it had significantly less miles). It’s bmw approved dealership it wasn’t a side garage and had done purchase a car previously this way.0

I have to say your case is extremely weak.
You're saying you knew from the outset that this wasn't the car advertised yet you chose to keep hold of it rather than the option that was available to you at the time, ie, handing it straight back. Even if you are able to now reject the car you won't be entitled to a full refund as the dealer can deduct an mount for the 6 months you've been using a car.
If you're not getting anywhere with the car salesman then you need to speak to the dealer principle, BMW Customer services and Lombard finance (in no particular order).

Again a luxury car motorist in distress comes to this forum and receives nothing but abuse. He's been called careless, irresponsible, and lacking wherewithal. The only thing he's not been accused of is being an amber gambler and presumably that is coming.
He clearly says he raised it at the time and every month since. The wrong car arrived outside his house, bungalow or mews accommodation and he has been fighting for his rights ever since.0 -
He knew the car wasn't the one he ordered but signed a paper saying he accepted it. If I ordered a red car and a blue one turned up you can be sure as hell they'd be told to go away and not come back until it was the one I ordered. I certainly wouldn't sign to say I accepted the vehicle and then hope I'd be able to sort it out down the line.
Given he accepted the vehicle unless there is something wrong with it the best he's entitled to is any difference in value between what he ordered and what he got. The time to reject the car has long since passed and from his responses he didn't have an intention to reject it anyway because he needed a car.This is a system account and does not represent a real person. The OP chose to keep the car after being offered the chance to refuse the car. So i have no idea exactly what the OP is expecting when they chose to keep the car. you think it ok to accept a car that is clearly not the right one (regardless of wether it is a luxury car), rather then refuse delivery .0 -
