    Hello ,so way before I have recieved a letter from the courts stating where my hearing will be at .

    I received 2 letters in July.

    One from excel and other from elms legal

    Apprently " recently obtained country court judgement against me" and "we have been awarded a county court judgement against me at the start of July" one sayiy they want 185 and the other syaing they want 275 or even 365

    How are they allowed to use those words when I have a latter infront of me from the courts dated the end of last month telling me where proceedings/ hearing will be held regarding the case? Makes 0 sense??

    They are not "allowed" to but that won't stop them. As hinted at above by waamo, this could be used in your Witness Statement to prove unreasonable behaviour and increase the amount of your claim for costs.
  • Hi Guys quick question.

    I submitted my defence few months ago... to the court

    Come round to look at starting my witness statement.

    My court date is middle of decemeber.

    I may have misjudged but did I have to send a copy of my defence to excel? I have not.

    If I had to is there still time?

    The court sends a copy of your defence to Excel. Do you have any reasons to doubt Excel have received it?

  • No not at all, It just came to me creating my WS and looking through and example. Seeing how an individual had said they are going to resend a copy of the defence, just panicked slightly.

    When is your deadline to send WS and bundle to the coutr and claimant? Its on the hearing letter.
    USUALLY it is 14 days before.
  • I have a month to complete it... I just want to start it off and do bits each few days

    I have had no response at all from excel other than those letters from them and there debt collecting company saying I have a ccj against me, which is incorrect.

    I have noticed how a few other examples of witness statements refer back to what excel have replied with in the defence.

    I have been looking at other copied of witness statements and people have been fortunate enough to compare the claimants witness statement when writing their own witness statement. Something i am not able to do as I have not received one from excel yet :( I have wrote a good chunk but I don't have a comparison.

    Could I please ask. I send copies of the WS to the court and to excel via post? with the witness statement will this include all the picture printouts I have?? and the letters I want to discuss that have been threatening? or can I just bring those along on the day?

    I have really started to get fed up with this as its been hard work, but nearly at the closing stages, I felt very upbeat about winning the case but tired of it now.

    I will make sure that I get the statement sent with or without pictures/ letters either via post or email, 14 days before the hearing.

    You have a Notice of Allocation from the court which says something like...
    Each party must deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than [ . . . ] [14 days before the hearing].
    What do you understand by "copies of all documents on which he intends to rely at the hearing"?

    "Documents" includes all your evidence and your Witness Statement.
  • Thank you very much, I will make sure i send all copies of everything to the court and to the claimant....

    Am I best to just send my witness statement, or shall i wait to hope that excels copy comes through the post so I can counter what they are saying whilst keeping an eye on the 14 day deadline.

    Could someone also give me an indication on counterclaims... making my anxiety worse than it already is.... how do I know how much to claim etc? or do I suggest that I just pay the parking fee of 2 pounds to re-mediate whats happened.
