Delay the despatch of your WS until the last moment in the hope that you receive the Claimant's WS and have time to tear it apart in your WS.

You are far to late to be considering a Counterclaim, but I don't think that is what you mean.

Instead you need to create a Costs Schedule - as described in post #2 of the NEWBIES thread - and file and serve that along with your WS and evidence.

CORRECTION!!!!
Google coming to the rescue, saved the input in my text box of the tracker.
I now have signed evidence that EXCEL received my address change notification!!!

Wednesday will be 14 days.
Can anyone advise? will I still have to send mine tomorrow without any reflection on their statement???

my witness statement has to be sent in next 2 days,

I have not received witness statement from excel,

I am having thoughts this may be something to do with the fact I changed address during this whole process.

I notified both the court and excel of my address change,

I had mailed my notification of address change to excel with recorded delivery. I checked days after it had been sent and it was signed by an individual.

I wish i had screen shotted that page. The reference number of the tracked letter I sent to excel was in a lost wallet so I can no longer show I had proof they had received it.

I may just be panicking, but its starting to look like im going to have to send my witness statement off without having the one from excel to breakdown.

Meantime email the DPO at Excel and inform them of the correct address and to erase the old one due to GDPR

Attach a proof of I D such as the V5C or claim form

I did not want my witness statement to be late. I have sent it off with everything included. Even with the screenshot of proof of excel receiving my address change via recorded mail.

Many thanks for all your help guys. I cannot wait to get this over with. A year later!!!!!

In fact, given you have to *post* your WS to Excel, unless you have their agreement to email it, you are *already* late if your 14 days is up tomorrow. You MUST allow two days for post.

Have you called the court to see if THEY have a copy of Excels WS? Either way you write to thec ourt informing them the claimant has failed to meet the courts order of xxx date made by yyy namely they failed to serve the requiremed WS and other exhibits on you. You ask the court allows no releief from sanciton, as they are a company well versed in litigation and have no excuse not to get this done.

Could someone also give me an indication on counterclaims... making my anxiety worse than it already is.... how do I know how much to claim etc?

Have you filed & served a costs schedule with your WS?

Did you file & serve Schedule 2 of the Consumer Rights Act as well?

I have served and filed a costs statement

but not the shedule 2 of the consumer rights act.

I sent it off this morning... Via 1st class recorded.

The lady mentioned that because its getting forwarded out from the post office collection at 12 midday. It will arrive to them both by tomorrow
