Husband of tenants died, wife was given time to pay - now she is refusing to communicate

    I am not nagging her, and by the way you have no idea what is going on in other people's lives. I have a few health issues of my own to contend with, and if she goes much more than three months not paying, it will start affecting me. And by the way plenty of people treated my mum despicably after my father died thanks. I did as much as I could when I was home with her but they waited until I returned to work to come round and nose around.

    If you decided to give her 3 months until Feb 22 to sort things out, and told her this, why are you assuming bad faith on her part already? She probably took you at your word that she had that much time to find a solution, and has already paid some of what's owed. She's dealing with a million things now, and a lot of contact from you/your agents won't facilitate you getting paid quicker. Instead, it adds more stress and makes it more likely that something - maybe the money you're owed, maybe something else -doesn't get sorted because her mental bandwidth is exhausted.

    Your instincts were right and generous to give her time to figure everything out. Let her know that you're available if she needs to update you, but otherwise leave her alone until the date specified.

    The only details I have for her are my mother's address. I sent her a card and letter when he died. However, the managing agents are the ones that have been in contact with her. They were sympathetic and were the first round when SHE called THEM in a panic after her brother in law had a screaming match with her and refused to come to the funeral to see if she was ok. They are not the evils here either. We have all been on good faith with her. She told them she would pay January's rent when she came back - she had not and when they tried to get in touch, she would not answer.

    They are in as much of the dark as I am - and they are the ones closest to the situation.

    I wish I hadn't bothered asking what her visiting the council would mean now.

    Can I ask when did the tenancy start, date they 1st moved in your mother's bungelow ?
    Advice given on Assured and Regulated Tenancy, Further advice should always be sought from a Solicitor....

    Mods - please delete this thread. I came to ask for advice and have had quite a bit of flak for hounding a widow - I have never even met the damn tenants. Sorry for trying to do the right thing but asking for advice for something I didn't know. Sorry for not being obviously as knowledgeable and wise as all of you here. Thanks for nothing.

    Simple trying to see what type of tenancy they have, when I asked the date they 1st moved into your former mother property to advices you .


    There may be succession rights to the tenancy ?

  • I think you've been more than fair. Ignore the other comments. For what it's worth my friend lives in a row of mixed terrace houses. When the 97 year old woman who lived next door but one died the housing association wanted the house cleared and house cleaned in 15 days. Her 79 year old son found this difficult.

    I realise you want to help and I acknowledge to all the keyboard warriors that I have made mistakes in the posts - I have deleted as much as I can and I have asked for the post to be removed.

    They moved in December 2015 - I requested professionals only and I believe it is a Assured Shorthold Tenancy for 12 months at a time because we have a discussion annually about whether or not to increase the rent. In the past I have decided not to.

    I have things going on in my own life and this rent at the moment was my main income - what I earn freelancing doesn't quite cover the bills. So yes - this WILL affect me a lot. We have ALL been through bereavement and so I can imagine what she is going through which is why I wanted to give her leeway.

    Someone (I forget who) at least came up with something helpful to say I can stop the managing agents from doing anything until 22 February but them going to the soliicitor was news from the blue. Hence my asking questions.

    I am obviously a terrible person so will go jump in the Yarra River forthwith which I am sure will make you all really happy.
