Bullying and Undermining

Hi,

I've been in this employment for over two years (so I am entitled to the provisions of the fair dismissal).
Since beginning of this employment I've been faced with persistent undermining of my work, constant criticism and reducing my bonus for vague reasons.
To be more specific, I've been working on projects which have been always understaffed and I've always asked the top managers to give me more staff to accomplish the project. But I always ended with useless promises whereas at the same time other teams could easily recruit more staffs to keep up with the workload.
My priorities have been redefined very but the after a while top managers found out the it was my fault that the original tasks were not completed.
Also, in annual assessment sessions they always bombard me with criticism whereas the other peers did much worse with much less criticism and so i end up receiving a fraction of my bonus.
This job has made me a lot of stress and I am now doing a therapy.
I've decided to change the job but the market is not very good at the moment.

Now, I want to know what options do I have? Are the above points can be used to sue the employer in the court (if HR does not do anything about it)? If I make a formal complaint, com[any is able to fire me and then it will be an unfair dismissal? Can I ask for compensation for the stress and humiliation I've faced in the company?

I know that many of the above should be answered by a solicitor but I want to know anyone else had the same experience?

    Options are-

    Look for a new job

    or

    Concentrate on the job you have, forget about 'other peers'.

    If your work is not up to the required standard then management are allowed to take steps to help you improve.
    Where are you getting the idea of unfair dismissal from

    Put all thoughts of trying to sue out of your mind, what exactly do you think you can sue for?

    Looking for another job is an option but even in that case I wont give up.

    Based on the governmental publications, bully and harrasments are issues that should be addressed by the employer and may be sued in court. You can read one of them here:

    My managers have been undermining me which caused distress for me. My performance is much higher than their standards but it has been always criticized for junk reasons which have not applied to the others. It is not my first job and I am not a graduate moaning about hard work. I worked under much higher pressure with no complaint as my job was appreciated and I was not bullied.

    So, I repeat my question of what are the options when you face bullying and harassment.

    Try and prove you have been bullied and harassed. Management will turn around and say you were not performing and needed micro-managing
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales
  • thanks. of course they say it. But what if I am able to prove it as there are various objective reasons that they just did it to undermine the job and it has been persistent over a long time?

    I did read your post so I repeat my answer.


    Look for another job or speak to your manager about your concerns.

    Clearly they don't think your performance is higher than their standards if you are being criticised for the standard of your work.

    Nothing you have written suggests that you are being bullied or harassed.
  • To be honest without more details as to the instances of undermining you and what was said or done to undermine you. And without knowing the circumstances or contexts surrounding the critism thrown at you. Then the details you have given so far are way to vague for anyone here to give you any advice on what options you may or may not have.

    Granted some may say leave and find work elsewhere if your not happy where you are. And that would be reasonable and fair advice, given the lack of information so far.

    from this sentence it seems you did not read or dont have the knowledge as I am not explaining the whole story and my proves in this forum. I just wrote a summary of what happened.

    So instead of judging people (when you dont read their post) please do not post. It would be appreciated.

    You appear to be yet another poster who has already decided what your options are. You say that bullying and harassment are actionable in court, that your performance is great but your managers don't appreciate what a star you are, you are miles better than your colleagues (whose performance appears to be being discussed with you, since you know so much about it, which is quite inappropriate) and so you are entitled too sue your employer.

    I'm looking forward to seeing how that goes. Do keep us informed.

    If the job is not right, then it's time to go.


    I left my last job because they put blockers in my way and criticised me for not achieving goals.


    I just bumped into someone in the supermarket who still works there and apparently they are still finding it difficult to get/keep staff.
  • It is not possible to explain them in full. it will take pages. But I gave some clues:

    In summary:
    -being understaffed since day one whereas others did not have the same issue
    -constant changing the priorities and then complaining why they changed!
    -complaining about any single problem in job whereas others did much worse
    -and funny point is that most of the complaints (if not all of them) happens during annual review which determines the bonus

    So, I dont know how much more details are needed?
