    He also said to me that if i go into court he wouldn’t accept a payment plan??? Is this possible? I can not afford it without a payment plan?

    Even with a payment plan, you won't avoid a credit crushing CCJ if you lose in court. It's !!!! or bust on that.

    But you need to go in there with a positive attitude and try to win.

    Thank goodness you didn't accept the slimy 'offer to settle'. You really SHOULD have been ready for that, I did tell you to read other winning threads to know what happens. It would have kept you much calmer, had you read about this normal stage outside the hearing room and to ignore them.

    IMHO, inexperienced Defendants should NEVER chat to the other side, beforehand.

    Anyway that doesn't matter now - well done - another one bites the dust! :T

    Tell us please:

    - which Judge?

    - which court?

    - what can you remember, give us a court report like you see on all the others winning threads we wanted you to read. Please tell us how their claim failed?!

    I assume you didn't ask for costs as you seem unprepared? Shame if not, missed opportunity. In post #67 I advised you to prepare well for the hearing.

    Well done! A useful thread to read to illustrate the tactics of these grubby solicitors and their pre-hearing 'offers'. Do report back and tell us how spectacularly they lost!

    Sorry i’ve been busy with my Uni dissertation. I will post a report on what happened later tonight.

    Hi so my argument points were as follows
    • the signs were not lit well or visible in the dark
    • there weren’t any entrance signs
    • charges were excessive

    which were all valid points to the judge, especially the excessive charges. Although they were sending me £243 x 3 fines to my house, at the court it wasn’t only £160 each fine. Even the additional £60 was questioned

    The claimants points were
    • I should not have parked there without a permit
    • Why didn’t i appeal any of the fines
    • Why did i park there 2 additional times after the first ticket

    The judge also accepted the claimants argument points as valid too.
    However these were my counter arguments
    • i didn’t appeal as i wasn’t able to gather evidence from my employer within 21 days
    • It wasn’t clear whether i rewquired a permit if i was an authorised parker (even though i wasn’t)
    • the second ticket wasn’t placed on my windscreen so wasn’t aware after the first ticket until i received two more

    HOWEVER
    the reason i won the case was because, i said i was an authorised parker as i was an employee of the shopping centre (which i am) although i didn’t have authorisation.
    BUT
    i won because there’s no instructions on how to obtain a permit even if i wanted one.

    the claimant stated i should have sorted this with my employer but the judge said that i did my part and could not have done anything more. there were no instructions on how to obtain a permit, i was not trespassing as i was a worker there but i could not do anything myself and even the employer didn’t have instructions on how to authorise me.

    3 cases dismissed :)
