Surely that letter that tells you the date of your hearing answers that?Is 21 days before the hearing, the deadline for my witness statement?
Generally it is 14 days, but it can be anything and will be specified.
You need to be re-reading post #2 of the NEWBIES thread. What does a witness statement include?
There is lots of guidance and several examples there.0 -
Thank you,
“I am also receiving court threats from National Debt Collections LTD on behalf for a parking fine with F1rst Parking at Aston University.
I have heard they have never taken anybody to court, it says I have 14 days to pay or they will commence legal action including bailiffs to seize goods.
Should I pay the £170?“
Any guidance on this?0 -

MISLEADING AND AGGRESSIVE COMMERCIAL PRACTICES
https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/721872/misleading-aggressive-commercial-practices-guidance.pdf
Part 1: Liability for misleading and aggressive
practices
The 2008 Regulations make misleading actions unlawful
(see regulation 5). An action by a trader is misleading if it
contains false information or if it is likely to mislead
the average consumer in its overall presentation.
Consumer payments and “civil recovery”
The Regulations amend the definition of a “transactional decision”
to expressly cover demands for payment from a consumer in full
or partial settlement of the consumer’s liabilities or purported
liabilities to the trader (see reg 2(1A) of the 2008 Regulations).
This means that misleading and aggressive practices in respect of
such demands would now clearly lead to both criminal sanctions
(under the 2008 Regulations)
REPORT THEM TO TRADING STANDARDS, THEY ACT UNLAWFULLY
They CANNOT do what they claim ...... BLATANT LIES0 -
No, is the answer, but start a new thread about it later on, IF they try a small claim (please no new thread about a case at debt collector ignoring stage as there is nothing to add above what we've already told you!).Should I pay the £170?“PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi i’ve made a mistake.
I’ve been so caught up with final year University exams and deadlines that i thought the deadline to submit my witness statement was 14 days before the hearing.
The hearing is on the 19th March 2019.
I haven’t sent my Witness Statement yet and was planning to do so Monday.
I just read on the letter that it says “all documents on which that party intends to rely at the hearing no later than 21 days before the hearing”
What do i do?
If i’ve missed the deadline should i still send it?
I went to court a few weeks ago and i asked the deadline and i’m sure she said 14 days before.
It is my fault i should have done this earlier but i got caught up with my dissertation and exams.
What is the best possible option for me now?0 -
You must file and serve you witness statement and evidence as soon as possible.
That means - hand deliver the stuff to the court on Monday morning and email it all to the Claimant the same day.0 -
OK also,
Gladstone counteracted everything i had said in my defence, they gave pictures of my car, signage and MAP views of the car. However even though my three cases are merged together into one.. They sent it for 2 of the cases separately.
I did send them the same letter i sent the court in merging them and i also emailed them.
ALSO at the front of the witness statement, they said:
“the assumption is that our client is not attending the hearing and therefore we kindly request this notice is treated persuant to CPR 27.9, However on some occasions, our client may wish to intend to do so.”
i’m super confused because the court is aware i’m having a hearing and i sent off the court hearing details to gladstones via email too. Hopefully this means they might not show?0 -
Don't get your hopes up, just do as advised, take the WS to the court Monday morning, e-mail to PPC/solicitor. Everybody gets the "you've got a bad defence" letter, they are just trying to unnerve you.0
-
All the documents i previously emailed i never got a reply for with Gladstones. But i will try different emails and get it done Monday.
Thank you0
