Once you have definitely decided you will not be attending the hearing, you need to write to the court, and of course sending a copy to the Claimant, stating that.

The court must receive that letter at least seven days before the hearing.

And if you don't attend, there is no point in filing a cost schedule.

While talking about costs, I wonder whether the Claimant would seek unreasonable behaviour costs for having to sift out all the extraneous bumf from your evidence?

And if you're not there you won't be able to argue against that either. ;)

Also just noticed that your Witness Statement refers to a 'Beavis Case Sign' exhibit.
You have a document entitled Beavis case sign.pdf.
That document is seventeen pages of pure text - no image of a sign at all.

    Another point...
You have included as an exhibit a copy of the IPC AOS CoP.

The copy you have included is several years out of date. For example, throughout it refers to The Independent Parking Committee.

That aside, paragraphs 18 and 19 of your Witness Statement in that Google Drive folder refers to the BPA CoP, and in para 19 practise is spelt wrongly.

Which is it - BPA or IPC?

BPA, let me get this changed and reprinted.

    With kind regards.

Just tell us how many pages you have printed for your Witness Statement please. You might get more advice then.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I am sure there is, but I can't be bothered with any more basic proof-reading.

Why can't you get a relative or friend to read it and see if it makes sense?

OK - badly phrased question on my part.

How many pages formed your entire bundle?

    ~60 IIRC

At least it is one stress of my head. Hopefully it will go my way, otherwise I will be trying to get the CCJ set aside. I value my credit score, so will be apprehensive!

On what grounds do you think your defended case could be set aside?

If you lose, and you pay what the judge orders you to pay, your 'valuable' credit score will remain intact.

So you omitted the whole Protection of Freedoms Act, rather just using the extract of Schedule 4?
