Please can someone help, I can’t find anything on here about people getting a letter from Gladstones, with court forms attached asking for a papers only hearing. I saw,on Parking
Pranksters site not do this and go for oral hearing, however my son was using my husbands car so the letters have been intercepted so he didnt see the fines. There were 4 that were ignored basically thinking it was a scam. My husband can’t go to court, he would go beserk if he knew, I have sent claim forms back prior to this stating in the defence that the keeper wasn’t the driver, but now have this come through, what will happen if I don’t accept a papers claim? Will it still go to court?

    read the BARGEPOLE posts linked in the NEWBIES FAQ sticky thread , post #2 , plus the other info in that same post, because your question was answered months or years ago (its been asked and answered hundreds of times over the years here)

    it will only "go to court" if the claimant pays the court hearing fee

    it can be dealt with "on papers" anytime until say a week before the hearing (but dont quote me as I may have got this timeframe wrong)

    for now, proceed as if its going to a court hearing

    The NEWBIES is on the main parking forum page just under where you clicked on the newthread.gif button.

    You can get to it by clicking your back button/arrow, or click on the Forum Jump "Go" button you will find near the top or bottom right of this page you are on now.

    It's advisable to read it all, but Post 2 has a guide to court that takes you through step by step.

    Court is a judge in smart clothes with the claimant and defendant in a smallish room. No drama and no reputations shredded.

    Why? Your son is the victim here. These people are out and out scammers, acting at the very fringes of, and occasionally beyond, the law. It is no shame to receive an invoice from them for an alleged breach of contract. Your husband needs to do a bit of reading and help your son get these parasites off his back.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed in the house as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P.
    for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.

    So, your husband is the registered keeper, and the named Defendant in the Court Claim.

    You appear to have filed a Defence stating that the keeper wasn't driving. That is no defence at all, unless you can establish that the Claimant failed to comply with POFA 2012.

    You have then forged your husband's signature on the Defence, and are now proposing to do the same on the Directions Questionnaire.

    Do you not think your husband might go slightly more berserk when he gets arrested for perverting the course of justice, or when the bailiffs turn up on your doorstep to remove your TV?

    I suggest you come clean about this now, and let him deal with it properly.
