The Defence should be filed via email as described here:

1) Print your Defence.
2) Sign it and date it.
3) Scan the signed document back in and save it as a pdf.
4) Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
5) Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
6) Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
7) Wait for your Directions Questionnaire and then re-read post #2 of the NEWBIES thread to find out exactly what to do with it.

Just one more thing, I received the letter Friday about dq so I’m ok sending this before the courts write to me? As the letter I have been sent is just a copy of the one Gladstones sent to them..

we know, you are trying to take on something that is beyond you at the moment

the cold facts are that this is all in his name and you have muddied the waters by trying to deal with it, which you are not legally entitled to do as you have no Power Of Attorney, no legal right to do so

sometimes a good samaritan makes it worse, especially if they are not guided at every step

so this has been done in the correct name , meaning that HE has defended this in HIS OWN NAME on the government gateway ?

so now read the BARGEPOLE timeline thread and the advice when you get the papers only notification from GLADRAGS which is what you appear to have received

do not fill in the GLADRAGS form

use a laptop for this, not a phone

a smartphone does not give you full internet access, its a cut down version, where some stuff is missed out

a laptop gives you everything, including the relevant links

do not do any more of this on your own, check with us first, do not fill out that gladrags letter

So then you DID lodge a defence in his name all along and do not need to email another copy to the CCBC.

NO you do NOT use the blank one Gs attached. Bargepole's post in the NEWBIES thread, about what happens when, tells you not to.

Yes I did say I did this, as I realised now this was wrong, It’s just that I sent the the court claim back to the courts who then forwarded to Gladstones,
I assume they weren’t interested In what it actually said as it’s now at this stage. So the prevous advice I had to email a defence isn’t what I do now, I just wait for the papers to which I have no idea what to expect and what to do for the best then?

I thought in Bargepoles post it meant I was supposed to leave the defence section clear on the court claim form I already mucked up by adding my defence there, I don’t remember reading about what happens in papers only situation without it going to an oral hearing, it made sense to include my defence but this time addressed to the courts. I’ve tried so hard to understand all this but I just don’t seem to get it right.

as long as the defence was done in the name of the husband, then no need to mail anything

you are now awaiting the DQ papers from Northampton CCBC, which are filled in (in theory by the husband , or at least signed and dated by him) and the BARGEPOLE tiomeline link tells you what to expect and when to expect it

it also tells you how this DQ form is filled in too

once that is done , the CCBC will read both sides and then send papers for the local court to contact you (your husband actually) (so the court one that YOU (your husband) nominate on the DQ form)

the claimant then has to decide if they are proceeding and pay a court fee to do so

after that, you get papers stating the date of the hearing, the judge etc , and when to send in the WS and evidence etc

at some time in that intervening period, but possibly more than a week before any hearing, the defendant could tell the court that they are not attending and to hear it on papers alone

so it can always be heard on papers but the court can be notified much later in the process I believe (in a few months time , possibly 5 or 6 months time)

yes , you did things wrong, because you have no training in this topic and didnt research it properly

on the other hand, it was never your job, it was your husbands job as its HIS NAME on the court claim, nobody elses

so dont beat yourself up for others peoples mistakes


just double check that the defence wasnt submitted in your name instead of his, as that WOULD be a problem
