    yes it was sent in the post (and the time to appeal is long gone), but you can use the reference and website they gave you to login ON LINE , which is the OL in MCOL , because you have a Money Claim , a court claim (most things are done online now, even if you get a letter in the post about it)

    you need to tell us if you are prepared to do the research and spend the time and effort necessary in fighting a court claim in your local county court ? (or not)

    if you do not understand this process at all , then I will tell you what MARTIN LEWIS himself would telll you if you asked him

    "consult a lawyer and get legal advice , pay a lawyer to defend you if you cannot or will not do this yourself"


    the only problem in doing so is that it will cost you several or many hundreds of pounds to hire a lawyer for this task, which is why the D.I.Y. option is preferred

    if you are not up to fighting this , then its not worth us typing up the help that is needed , plus we need you to read , digest , and understand what you are being told to do , to read , where to go, how to find what you need , where it is sent and how it is sent , what printing needs to be done , etc

    its not simple or easy and nobody said it was , it takes time , effort , reading and research , and understanding too

    no , but there are links in the NEWBIES FAQ sticky thread , third thread down from the top of this forum, which is where you should be looking for all of the info if you intend to fight this , specifically , scroll down to post #2 of that NEWBIES thread and study it very carefully

    the email address to send the SAR will be on the privacy page of the parking company, along with the DPO details


    generally speaking , you will be directed back to that thread and post all the time , every time you ask something , because its all covered in that one post, with links

    I am prepared to fight it nothing ventured nothing gained but I really need your help. I am dyslexic so processing info can take a while.

    So the claim form they have issued is in the county court business centre and the court address is in Northampton which isn’t even near where I live?

    So if I go to MCOL I CAN USE THE reference number on this claim form to put in a defence
    Correct ?

    yes I know you are dyslexic, you said so in an earlier post, I too suffer from a mild form of dyslexia , amongst other things , so my advice to you is SEEK HELP in order to understand this, be it a friend or a relative or carer or whoever, dont do it on your own. you did explain that you are dyslexic, you did NOT explain why you are doing this on your own INSTEAD OF SEEKING HELP from a friend or neighbour or family member etc)

    we can only point you at the information you need, but you or somebody else is going to have to process this info and do what you are told to do , so get some help

    the CCBC in Northampton is a government office , not a court , same as the DVLA in Swansea, they have to put it somewhere, even if it was Durham or Penzance or Carlisle or Belfast (like where the DWP letters usually come from)

    if you google the Northampton County Court its a completely different address in that city, so this claim pack came from a government office in Northampton, not a court (the clue is BC in CCBC - Business Centre)

    the fact that it is in Northampton is irrelevant , as you wont be going there and even if you did they would not let you into a government office without an employee pass

    google your nearest county court for civil court claims , THAT PLACE is where this will go because you will tell the CCBC this later in the process , at the next stage after your defence is filed

    so if you are in Birmingham, then you will put Birmingham - gettit ?

    yes you are correct , EXCEPT you wont be filling in that defence box at all

    you login online and do the AOS by using your reference , but leaving the DEFENCE box blank , not even a full stop !! nothing at all, the NEWBIES thread has a walkthrough guide explaining how to do this task online , please read it

    your defence will be EMAILED as a pdf document attachment instead, to their email address (KeithP puts all this info in various threads once he know the DATE OF ISSUE , which is why you were asked for that ISSUE DATE , which you said is 01 APRIL 2019)

    so going online is to acknowledge the court claim, nothing more

    your SAR goes to the DPO at your PPC by email, to get all their data

    then you start drafting your legal defence (not your "story")

    if uncertain what to write , here is what coupon-mad said in one thread

    most people can use bargepole's concise template defence from the NEWBIES thread, and add in a point or two about the facts of the case/contravention/why they are not liable.
    And a point about no landowner authority as seen in other defences.

    There letter was dated 1st April 2019 and I didn’t receive till about 4th April and it says reply in 14 days

    I was told to add the holiday Inn mangers to defend their conduct, or required to attend witnesses because they would not acknowledge that the person was a genuine patron of the hotel on that date

    With a Claim Issue Date of 1st April, you have until Tuesday 23rd April to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox file linked from post #2 of the NEWBIES FAQ sticky thread. About ten minutes work - no thinking required.

    Having done the AoS, you have until 4pm on Tuesday 7th May 2019 to file your Defence.

    That's four weeks away. Loads of time to produce a perfect Defence, but don't leave it to the very last minute.


    When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
    6. Do not be surprised to receive a copy of the Claimant's Directions Questionnaire, they are just trying to put you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.
