    I have received notification this morning that due to the claimants failure to comply with the deadline the claim has been struck out and the hearing vacated!! No mention of my costs though.....

    IMHO you are unlikely to get costs pre-hearing but read Loadsofchildren123's post from last month about how to word a letter if you decide to ask the court.

    Hi guys URGENT HELP required!! I have just received a phone call on a private number and voicemail from CEL regarding the 'hearing' tomorrow wanting to make me an offer to settle...although the claim has been struck out and the hearing vacated (as per letter from the court.) Do i call them back, call the court or simply ignore?? Am actually fuming that they are still continuing to harass me so i've half a mind to call them and get them what for..

    Just call the court to make sure there isn’t a different claim going through. CEL play fast and loose with the courts and their procedures.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Wow, you have that on voicemail?

    Right:

    1. Make a recording of that voicemail in a way that you can send to the named Judge who struck it out, confirming the date of the recording as being AFTER the claim was struck out and the hearing vacated, and indeed the day before the hearing would have been, and

    2. Send it (the recording, on a USB stick maybe - something an elderly Judge can handle!) to the court with your costs schedule (time at £19 per hour on this scan, at least ten hours, maybe more) and ask for your costs on the indemnity basis using these sort of words and quoting the CPR rule that supports costs being awarded when a party has acted 'wholly unreasonably':

    They emailed me a copy of their witness statement this morning telling me they would like to make me an offer and to contact them if i wanted to settle. Then left me a voicemail, then continued to call me a further 3 times before lunchtime! (which I ignored.) If that isn't harassment then I don't know what is. I called the court just to confirm the hearing 100 per cent is not going ahead tomorrow which they did do. I then emailed CEL back to notify them and to tell them if they continue to harass me I will take it further - absolutely unbelievable. Goes to show what a cow boy outfit they are also as they didn't seem to be aware the hearing had been cancelled! I should have ignored them and let them show up at court tomorrow!

    But you need to send that email and voicemail to the court to urge them to order the Claimant pays you costs on the indemnity basis of some 10 hours or more at £19 per hour - it would be rude not to. One letter.

    CEL have opened that door for you, and this catches their fingers in it.
