    YES, but that's the whole point of replying quickly and getting a foot in the door before the Judge looks at the case again!
    Reply to the Judge thanking them for their order and attaching your costs schedule, which you can say you have also emailed to the Claimant (do so).

    Hi All,

    Another one bites the dust.....I'm pleased to tell you that this 'claim' has now been struck out due to non-compliance by CEL with providing a witness statement in line with the court dead line. I would like to thank everyone from this forum who has supported me throughout this experience... without your guidance and help I would have undoubtedly thrown in the towel in sheer panic as soon as I received the claim form with the county court stamp as I imagine a lot of people do! In all honesty i'm slightly disappointed not to have got my day in court but equally just glad it's all over!

    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Congrats Hayley, so pleased for you and your grandfather.

    Para 13 your witness statement, grandfather no longer drives so does not have a Blue Badge.

    Your grandfather most certainly qualifys for a Blue Badge.

    The badge is for the use of, and belongs to the holder.

    Hence, can be used in any car etc by any driver, as long as the holder is present, or will be.

    Several friends are BB holders and they scare the hell out of car park scammers. sic.:rotfl:

    Not sure if this has been mentioned previously but you may find the above info helpful for grandfather and also for others.

    Another twist to the plot! I have had CEL witness statement in the post over the weekend (sent to the wrong address but my parents still live there!) They are offering to settle for £100 however back in March the Court wrote to me to say that the claim was thrown out as CEL did not send their witness statement back to the court in line with the deadline. Any advice as to what to do next? is it worth putting in a call to the court?

    Absolutely, why would you trust a PPC to get it right, especially if they are claiming you owe money on a closed case! Be prepared to be on hold for a while! Might also be worth checking MCOL to see if it reports the situation.

    Why not send it to the Judge who kicked the case out, with a copy of that order, and ask for him/her to order your wasted costs in responding and dealing with this constant scam, including four incidents of wholly unreasonable conduct (then list them):

    - failing to make a reasonable adjustment for disability under the EqAct 2010

    - failing to send a witness statement to the court, as per the order

    - continuing to process old data (sending a letter to an old address, contrary to the GDPR and DPA), and

    - chasing for 'settlement' of a claim that has been struck out.

    Attach your costs at £19 per hour for about ten hours or more (someone got 15 hours granted when they asked their Judge) and ask the Judge to use their case management powers and discretion without an application or hearing, and to follow the first order with an order for the Claimant to pay the Defendant's costs and to then erase the data they hold regarding the Defendant.
