    Dear Judge XXXX

    I am writing reference the above-mentioned Claim Reference.

    After submitting my own witness statement I received a letter from The County Court at XXXX dated 11th March (copy enclosed) stating that unless within 7 days of service on it the Claimant complies with paragraph 3 of the Order of Deputy District Judge XXXX dated 25th January 2019, the claim will be automatically struck out. I made a call to the court subsequently and was informed that the Claimant had not submitted their witness statement in accordance with this order.

    I have enclosed for your reference a copy of the Claimants witness statement dated 25th April, some 3 months after the fact. I should add that the Claimant has also processed old data in contravention of GDPR and DPA by continuing to send correspondence to an address where I no longer live despite being informed more than once of my new address, and this only came into my possession because my parents live at this address.

    I would like to know if it is possible to consider an order against the Claimant for wasted costs and for continued unreasonable conduct on the Claimants behalf to include:

    • Failing to make a reasonable adjustment for my Grandfather in respect of the alleged contravention in question

    • Failing to comply with the court deadline in providing a witness statement

    • Misuse of my data in continuing to send correspondence to an old address despite having been updated on more than one occasion

    • Chasing ‘settlement’ of a claim which has since been struck out.

    I would estimate a fair recompense for the expenditure I have incurred to be £19 per hour over 10 hours which I spent preparing my defence and witness statements. This includes Annual leave which I have had to use to attend the local library to use the scanning an PC facilities. This also accounts for parking fees, and postage costs which I have also had to pay.

    If possible I would like this to be resolved without the need for me to attend a hearing and for the first order to be followed with an order for the Claimant to reimburse me of my costs and then erase the data the hold concerning me.

    I wouldn't send the Judge the other side's WS. But send him/her a copy of the demand/settlement begging letter they posted to the wrong address.

    Was the claim confirmed as 'struck out' after that first order? If yes, say so.

    I called the court 8 days after the copy of the order I had received and I was told CEL still hadn't sent a WS so no further action I assume this means it was struck out as the order stated it would be automatically struck out after 7 days if CEL did not comply? At the time the person I spoke to said they would put a note on the record that CEL had not sent the WS in time. I called yesterday and was told they would put the WS in front of the Judge so I guess I will find out... I will be really annoyed if it goes ahead though after the order says it would be automatically struck out if they didn't comply within 7 days
