Background - received a PCN over a year ago For over staying in a sainsburies car park by about 15 mins. I’ve so far ignored all communications from them and now have received the claim form.
The car park is signed However the letters received initially were extremely poor, they did not even state who they were from, no details for appeal procedures just a letter showing two images of my car (not even clearly in a car park so frankly could have been anywhere)
an appeal was lodged but rejected on the grounds of being outside of the appeal period
Any advice would be appreciated

what is the name of the parking company ?
did the keeper complain to the supermarket ?
what is the DATE OF ISSUE on the claim form
what are the full POC details ? please write them in full, plus all the charges too
you say you have read the NEWBIES thread ?
in which case, WHY do you think it will affect your credit rating ? (it wont as long as the judgment is paid promptly) - so why do you believe this myth ?0 -
What is the Date of Issue on your Claim Form?
There is no risk to your credit rating.
Even if you were to lose in court, if you pay the amount owed within (usually) a month, then your credit rating will not be affected at all.0 -
Thank you both for taking time to reply. Please accept my apologies I am completely out of my depth hence coming here to see if it’s worth trying to challenge this. Details as follows:
Date on claim form 17th Oct
Name of parking company Civil Enforcement
Original penalty £100 (reduced to £60 with payment within 14 days) claim is now £331.38 - amount claimed £256.38 plus £25 court fee £50 legal representative fee
No communication whatsoever from the supermarket just this company.
I have understood from the newbies thread that I have to acknowledge the claim form within 14 days and then prepare a defense which is what I need help with0 -
Date on claim form 17th Oct
Having done the AoS, you then have until 4pm on Monday 19th November 2018 to file your Defence.
A full four weeks. Loads of time to produce a perfect Defence, but don't leave it to the very last minute.
When you are happy with the content, your Defence should be filed via email as suggested here:-
Print your Defence.
- Sign it and date it.
- Scan the signed document back in and save it as a pdf.
- Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
- Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
- Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
- Do not be surprised to receive a copy of the Claimant's Directions Questionnaire, they are just trying to put you under pressure.
- Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

mmm, you still have not edited your post at #1 to remove all hint of who did what or was or wasnt liable (hint - plead the 5th)
and there is no S in DEFENCE , so check from now on
you dont appear to have given us the exact POC details word for word, but a short summary, which is not what I stated earlier. CEL put all sorts of c*** into the POC details, including the costs and legal fees etc in order to inflate their claim
full details means - full details (but no PERSONAL details like VRM , claim ref , login password , etc)

Re spelling errors really not top of my list of priorities at the moment as you can imagine but will bear in mind for future.
RE POC I have no idea what that means please break it down for me? As mentioned I have no experience in these matters so am coming in more or less blind. Would be grateful if you could explain in layman’s terms what that means and will be happy to provide as much information as you need.

Court claims can be stopped right up to a day in court.
CEL know this, they do it enough times themselves

By the way, and not just to highlight perhaps how little you know about this stuff in offering your sage 'advice', it's not a fine.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
