  • Sorry I forgot to ask yesterday - I assume CEL are obliged to send me a copy of their WS in time for the deadline as stated from the Court? (this Friday) If they do not should I contact the court of just leave it?

    Leave it until Tuesday morning. if it still hasn't arrived then inform the court (and add this to your ammunition for your extended costs claim due to unreasonable conduct).

    If it doesnt arribve by the deadline, you ask the court to apply theusual sanction, which is to strike out the documents entirely
    THis means they have no proof of their claim, by dedfinition, and cannot prove anything. You win, theoretically.

    Surprise surprise no witness statement by the deadline date of today... have called the court who have confirmed they haven’t sent a witness statement to the court either..neither have they paid the £25 court fee or filed a proper application....seriously are these people for real???

    No, just vindictive - they've given you 4 months of crap to deal with as a result of you not allowing them to snatch a hundred quid from your wallet.

    I guess they'll be reasonably content to have put you through all this.

    Update - received a letter today to state that the claim will be struck out in 7 days from today if the claimant doesn’t comply....tick tock!!

    Reply to the Judge thanking them for their order and attaching your costs schedule, which you can say you have also emailed to the Claimant (do so).

    Do as Coupon-mad says, it keeps your door open, even if CEL closes their own door.

    Would I be entitled to claim costs though even if it doesn’t reach court? I feel like I should try as I’ve had to take time off work etc when preparing my witness statement to take the paper work into court and go to the library etc as I just don’t have the time during the week with work??
