Just out of interest, what would happen if the LL issued a second round of bankruptcy proceedings? It would seem quite obvious that OP is in fact unable to repay this debt, but it's not like he accrued it with any intention to pay it back... can you just keep going bankrupt repeatedly like that, or do you reach a point where someone starts looking more closely?

    https://www.citizensadvice.org.uk/debt-and-money/debt-solutions/bankruptcy-2/bankruptcy-offences/

I guess it would depend on the restrictions placed on the bankruptcy. Continuing to run up a 4K a month dept with no intention of paying it back??

Pedant alert - it's could have, not could of.

There are landlords who see a rental as a two-way transaction, and that is how it should be. It entails rights and responsibilities. I know how it is because I was once a landlord myself.

My landlord however thinks the agreement only says that I should pay the rent on the due date and nothing else. He is abroad and unreachable by phone and quite frankly he couldn't care less if the flat falls to pieces, so long as he gets his sodding £4,000 on the due date.

When I ran into trouble I expected that this man, with whom I had been in very good terms for years,
and with whom I had been EXTREMELY patient, because he's done ZERO maintenance, would afford me some flexibility and some kind of accommodation. I expected we would meet and discuss it. I was going to propose to him a payment holiday of about 4 months and then that debt could be spread in the following months. This would have been perfectly possible as it would give me the time to raise finance elsewhere.

As it happens, he didn't meet me, he texted me aggressively, threatened me, gave me impossible deadlines and I started to get health issues. He wanted ABSOLUTELY no discussion of terms - nothing. He just wanted his money and fast.

So I decided that the relationship had fallen through and I made no efforts to raise any funds or
pay him anything while the proceedings were ongoing (whats the point:?).

I have very bad feelings towards him for attacking me in my current situation. He is very aware of
my health problem and he doesn't care one bit.

My landlord however thinks the agreement only says that I should pay the rent on the due date and nothing else. - You do still need to pay rent on the due date, regardless of everything else. He is abroad and unreachable by phone and quite frankly he couldn't care less if the flat falls to pieces, so long as he gets his sodding £4,000 on the due date. - You probably owe HMRC some tax too, as you seem to be paying the LL directly.

When I ran into trouble I expected that this man, with whom I had been in very good terms for years,
and with whom I had been EXTREMELY patient, because he's done ZERO maintenance, would afford me some flexibility and some kind of accommodation. - He did, he accommodated you for 9 months. I expected we would meet and discuss it. - I'd expect him to evict you after 2 months. Strange how different expectations can be I was going to propose to him a payment holiday of about 4 months and then that debt could be spread in the following months. - That's just nonsense though. 1: 4 months is ridiculously long. 2: you couldn't afford it at 4k, so how would you afford 5? This would have been perfectly possible as it would give me the time to raise finance elsewhere. - But you didn't raise finance anywhere. You're not the wolf of wall street, more the leach of Lewisham.

As it happens, he didn't meet me, he texted me aggressively, threatened me, gave me impossible deadlines and I started to get health issues. - YOUR PROBLEM. He wanted ABSOLUTELY no discussion of terms - nothing. He just wanted his money and fast. - exactly, and that's his right.

So I decided that the relationship had fallen through and I made no efforts to raise any funds or
pay him anything while the proceedings were ongoing (whats the point:?). - I hope he puts your picture up in every letting agent up and down this country. Frankly I'd donate to such a worthy cause. I genuinely hope the council withdraws their offer of support. You've made yourself intentionally homeless and if I knew which council this was I'd be contacting them myself

I have very bad feelings towards him for attacking me in my current situation. He is very aware of
my health problem and he doesn't care one bit.

Neither he, nor I, nor anyone else cares about your health problem. They are YOUR problems; not anyone else's.

This Comms guy has it all figured out. How wonderful it must be to have all the answers. He must be a taxi driver.

No, and I'm not bankrupt and being made homeless...

It would probably help if you actually showed compassion and remorse. Your attitude is the reason why I also suspect you're a troll.
  • Ignore the troll Comms he'll go to bed soon....school tomorrow. lets all just ignore: but, in the unlikely event that it's true let's hope the eviction happens as soon as possible.

other than that, the exit is that way >>>>>>>>>>>

I could, of course, be wrong but I'm pretty sure Comms69 used to be Guest101 and is actually employed by the NHS in some minor management role. He comes across as really authoritative but is neither a solicitor nor a LL, AFAIK... None of which makes you any more entitled to behave the way you have.

I don't feel sorry for your LL either; they clearly are not going to starve for your delinquence in paying the rent but no LL should have you as a tenant. I wonder if you will end up on a ward Comms69 works on...

    Karma.

Just to be clear I've never claimed to be either a solicitor or a LL - The law around this kind of thing is really basic, and it's shockingly not taught in schools.

And yes still at the NHS for now :)

If I'm wrong I'm happy to admit it. On this topic, I'm not wrong :)
