Every question on here has already been answered a hundred times, here's a witness statement being used for a court claim v VCS, where that minor issue is easily explained in his point #9:

    https://forums.moneysavingexpert.com/discussion/comment/74834783#Comment_74834783

VCS just discontinued that case. It's over! This is easier than you might think.

ah very interesting. Thanks for this. I do sincerely apologies this forum is like a maze and i should have more due diligence in reading forums. All ive been doing is searching this forum so in the event i am missing these points i am sorry. Until you pointed it out i wouldn't have ever imagined it would be applicable to me.

So i'm just being preemptive here and im apologising if this is something that has been asked before but a sentence like in point 9 you've mention. Do i just copy paste something like that into word and take it into court with me, if the judge states or VCS claim why i did not appeal?

thank you so much. CRM on another note have spoken to VCS (phone and emailed them). Lets see what happens.
  • This explains why you are safe if they do go to court

If CRM are being obstructive, then give them some hassle. Send them a Subject Access Request. What you are looking for is evidence that they (CRM) did not pay VCS on time or did not put you on the Whitelist as they should have. If you happen to lose (though there is evidence that Newcastle court are not PPC friendly) then you will have the chance to throw CRM into the mix.

Do the same for Bradley-Hall. You registration is personal information in case they claim not to have any.

Thank you so much IamEmanresu. I've spoken to CRM who have emailed VCS. They have stated the same i.e "i already paid for the parking and had my permit".

I've looked at some of the points and links you and couponMAD have posted, and in some events the judge has still ascertained that the defendant still needs to pay "some" costs.

    Thanks guys

What IamEmanresu said was not to phone them, but to send them a SAR, this is a specific data request they MUST reply to, under the GDPR:

No, you do a defence and later a Witness Statement well before the hearing! As set out in the NEWBIES thread post #2 all about what happens when in a court claim.

    Hi I am couponMAD

So speaking to my housing manager, she has said VCS have cancelled one of the tickets. So looking back i have a suspicion that it is because the third ticket issued, they did not send me a NTK letter at all.

LOW AND BEHOLD yesterday saying the third ticket is in debt collection stage (the ticket where they did not send NTK). I believe after 14days or was 28 ? that this is no longer keeper liability. What a bunch of scrupulous chancers. Absolutely disgusting.

I believe giving my tickets to the housing manager who then passed the reference numbers on to VCS they realised they didn't send me anything for the third ticket.

OK so the advice has not changed. No phone calls. No speaking to people.

SARs to the scammers and the Housing Association. Ask for all data they hold on you, including communications between all/any parties about the permit and whitelist (what you are STILL looking for is evidence that they (CRM) did not pay VCS on time or did not put you on the Whitelist as they should have).

You have not got a claim or a LBC yet, have you?

So crack on with two SARs addressed to their Data Protection/Privacy Teams.

    I'm sending the SARS now.

No claim from LBC yet. I have until the 11th October to comply with the paying of the tickets :(

I'm assuming i needs SARS info before LBC

You have no control over when (or if) they issue a LBC, so get on with sending in your SARs. If you get responses before any LBC, all well and good.

They have a month in which to respond to your SAR, which is the same timeframe (30 days) you should be given to respond to any LBC. If you get your SARs away now, you should be ahead of the game.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Hi Umkomass and CouponMad,

I just got it confirmed that there is NO whitelist. No such thing exists. The reg details were required for the permit (paper with my reg printed on it). Bradley hall have confirmed this and so have CRM housing. I was told they PURELY gave me the ticket because the vehicle was not displaying a permit.

Now my housing manager etc is chasing VCS but she has stated they are digging their heels in because I did not appeal when i should off and that regardless a permit was not displayed.

I guess I'm in this for the long haul.

With respect to whether I have EVIDENCE pertaining to me paying for the carpark then YES i do (lease contract).

    @ COPOUNDMAD

My housing department shouldn't be paying VCS anything. VCS aren't the landlord for the carpark.

File it but at least you've been able to do most of the legwork at this time.

You could still send another letter to VCS saying you've looked extensively into the matter and as far as you are concerned you substantially met the requirements of the arrangement. Invite them to issue a claim and you will defend the matter. Get proof of posting.

They can either ignore the letter or send a claim. If they ignore and then come back later, you can argue unreasonableness and abuse of the court process / taking advantage of the Litigant in person.

Shows you won't be a pushover.

    Hello everyone,

    @IamEmanresu and @COUPON MAD @unkmomass

    NEED ADVICE

Housing CRM have come back and said,

    1. ONE OF MY TICKETS CANCELLED (im assuming because NTK was not sent within timeframe)...
    2. They have reduced it to £40 (Total sum payable). So from £160 x 2 tickets, they have asked me to pay this amount within 2 weeks.

I know its the principle and that i shouldn't even be paying it. Should I pay this and just relax and not deal with the faff or court etc or should i dig my heels in??

Edit ... P.S im assuming this is because they know they know they will lose and just want any amount of money. am I wrong??
