  • Well VCS are one of the many that do court but don't let that scare you, that's what they want, they thrive on peoples misery, parasites I suppose :)

Yes do everything you can to get the managers to cancel it, we often hear that these so called 'managers' cant do anything, out of their hands etc BUT its not, find out more about the contract and find out who has the power to cancel.

I had no idea how messed up the system was and how on earth these companies still exist. Worst case scenario it does fail (getting the managers to cancel it) should i just come here and post on this thread after the 10/10/2018, with respect to what VCS are sending me next. In that time is there anything else i can do?

EDIT: ah sorry it seems you already responded above. Does one need to pay the amount in full within 30 days or do these scammers accept instalment payments. Sorry i know im not being optimistic and hopeful its just knowing my luck it will probably end up like that.

    Thanks again my friend

complain to your MP then , like we have all done

until the Sir Greg Knight parking bill becomes law, nothing will change

    https://services.parliament.uk/bills/2017-19/parkingcodeofpractice.html

yes you should be complaining LOUDLY to whoever hired these par@sites (like the M.A. or whoever issues the permits etc, not VCS) and getting them all cancelled - this is by far your BEST OPTION - it always is

and yes come back to this thread for further help and guidance, dont start a new thread if its about this topic , not unless its something completely different

What, if you lose in court? You can arrange to pay in instalments.

You seem to be a cup half empty person! Gain some confidence!
    Upon logging into the paymyparking.co.uk,
So these so called 'CNs' were not PCNs at all? Just the 'not a parking charge' ones?

I hope you looked at the defences in the NEWBIES thread post #2 and saw that I've written a defence this week, about VCS and pieces of paper placed on the windscreen that said on the envelope, THIS IS NOT A PARKING CHARGE'.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD

No you are right i should really gain some confidence and trust the process.

Yes you are correct. The CN's that were attached to the windscreen were made to look like PCNs but they did note that "THIS IS NOT A PARKING CHARGE".

Ill be looking at that thread now. Thank you so much

    Hello sir and all,

So i've spent a good portion of the night just going through the wormhole of links etc. Feel much better. Just for affirmation and for my own peace of mind, as I understand it, there is nothing i can do now because I did not appeal the parking ticket within the timelines allotted to me. My best best is to either call the senior management of the parking complex/flat and if that doesn't work and the letters start to become ever increasingly likely that they'll go down the path of taking me to court, that I should thus come back to this forum (not create a new thread) but update this thread and elicit advice on creating a defence per everyone's advice and knowledge of winning this case.

^^^ The above is how I've understood what to do next.

Please correct me if I'm wrong.

Thank you again so much guys and really have appreciated all of you taking the time out to respond to my query and help.
  • The chances are that, if you seek the help of the development's management company or managing agents, they will simply tell you "We do not get involved. You need to contact the parking operator.".

What would be helpful would be to see the document which governs your parking on the development. Unless I have misunderstood something, this appears to be a separate parking agreement (as opposed to your lease or tenancy agreement).

Post what it says after redacting any personal data.

The likelihood is that it will not provide the parking operator with the powers which it claims. Of course, however, we can only give you a proper opinion if we know what the agreement says.

    Hi Elijay,

Thank you so much for the response.

No the parking i pay for is not separate from my lease agreement. The agency have added to the £40 pounds for per month to my lease... so my lease is originally 650 per month but when i asked for parking, they added the 40 pounds on top. All that it states is that i am allowed to park in that complex and just printed me out a shoddy permit.

I cant seem to upload any pictures as it states i am new. How do i get aorund this

Thank you guys so so much for responding to my queries

So basically I pay 40£ a month as part of my lease to park in this carpark.

I'd like to raise the possibility of there being two separate contracts here. This link shows that spaces at the location are rented out separately to all comers. And quite a common arrangement at VCS car parks

    http://commercial.bradleyhall.co.uk/properties/melbourne-house-car-park/
So when I moved into my studio flat... it came with off site parking (3 minutes walk away from the complex I live in). The price for a bay was quoted around £10 a week. So £40 a month.

As the location is physically separate then the lease for the flat [IMHO] will have no bearing.

Also is this student accomodation on a license and not a lease?

The issue as far as I see it is that there is a continuous contract and payment for it. The non-display was a reason for the ticket but the amounts will fail the Beavis test as explained in the link below. That is unless there was a failure by the OP to pay on time which would be a breach of contract.

Was there any break in the £40 being paid on time?

It should clearly state LBA, LBC or LBCC and give you 30 days to respond.
